Y,5-- 41-0 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT ELECTING TO PROCEED UNDER SECTION 6801, HEALTH AND SAFETY CODE, RELATING TO THE ADMINISTRATION OF DISTRICT FUNDS; CREATING AN ACCOUNT OR ACCOUNTS WITH AN INSTITUTIONAL LENDER AS A DEPOSITORY FOR DISTRICT FUNDS; PROVIDING FOR METHODS AND MEANS OF WITHDRAWAL OF SAID FUNDS; APPOINTING A TREASURER FOR THE DISTRICT AND SETTING THE PRINCIPAL AMOUNT OF THE SURETY BOND TO BE PROVIDED FOR BY THE TREASURER; AND ADOPTING A POLICY FOR THE ADMINISTRATION OF DISTRICT FUNDS. THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: THAT WHEREAS, the funds of the District have heretofore been collected, administered, paid out, and invested by the Treasurer for the County of Orange pursuant to Division 6, Part 1, Chapter 7, Article 6 of the Health and Safety Code, being Section 6780, through the use of the County Assessor's roll; and WHEREAS, the District desires to administer, invest, and disburse its funds as collected by the Treasurer for the County of Orange as heretofore set forth and as authorized by Section 6801 of the Health and Safety Code; and WHEREAS, the District intends by this Resolution to so advise the Treasurer for the County of Orange and to set forth provisions with respect to the administration of District funds, the establishment of an account or accounts with qualified institutional lender or lenders, the withdrawal or investment of the surplus of said funds, the appointment of a treasurer for the District, the setting of the principal amount of surety bond of the treasurer and adopting a policy for the administration of District funds. NOW, THEREFORE, BE IT RESOLVED that the County Treasurer for the County of Orange be advised by certified copy of this Resolution of the -1- District's intention to administer, pay out, invest, and otherwise be responsible for the handling of District funds collected by the County pursuant to Sections 6780 through and including 6787, Health and Safety Code; and BE IT FURTHER RESOLVED that the District Finance Director be and is hereby appointed Treasurer for the District with authority to act for the District as herein provided from and after the posting of the surety bond hereinafter provided for, said appointment to be at the pleasure of the Board of Directors of the District; and BE IT FURTHER RESOLVED that on or before the first day of October of each calendar year the District Treasurer shall post with the District Board a surety bond written by a surety compnay approved by the Board of the District in a principal amount as shall be established by the District Board, the premium for said bond to be paid by the District and the principal amount to be determined as an amount reasonably calculated to protect the District against financial loss of funds in the hands of the District Treasurer; and BE IT FURTHER RESOLVED that when the Treasurer has been qualified to act.as provided for herein, he be authorized and directed to open an account or accounts in institutional depositories qualifying pursuant to Sections 53530 through and includi',ng 53683, Government Code, for the purpose of adminstering District funds; and BE IT FURTHER RESOLVED that District funds be withdrawn or paid out only after approval of the Board of the District on written order duly executed by the President and the Secretary of the Board and entered in the minutes of the Board and specifying the name of the payee, fund from which payment is to be made, and the purpose for which payment is being made; and -2- BE IT FURTHER RESOLVED that the signature of the Treasurer and the Board Secretary jointly be required on any instrument withdrawing funds from District accounts and that a facsimile signature may be used for this purpose; and BE IT FURTHER RESOLVED that the Treasurer of the District be charged with the administration of and management of the funds of the District in accordance with Sections 53630 through and including Section 53683 of the Government Code as required by Section 6801 of the Health and Safety Code, the enabling section of this Resolution; and BE IT FURTHER RESOLVED that a policy statement embodying the pro- visions of Sections 53630 through and including 53683 of the Government Code be and is, by this Resolution, adopted as the method and means of administering District funds; and BE IT FURTHER RESOLVED that this Resolution shall not affect or disturb the payment of existing improvement bond obligations which, by the Indenture Agreement creating said obligations, require the Treasurer of Orange County to make said payment from District funds and the District, by this Resolution, reaffirms the authority of the Treasurer of the County of Orange to continue the payment of said obligations from District funds prior to any remittance to the District Treasurer; and BE IT FURTHER RESOLVED that District reaffirms its election to resort to the use of the County Tax Roll as provided for in Sections 6780 through and including 6787, Health and Safety Code, this Resolution being applicable only to District funds being collected and paid over to the County Treasurer as provided for by Section 6787, Health and Safety Code, and authorized to be administered by the District as provided for in Section 6801, Health and Safety Code; and -3- BE IT FINALLY RESOLVED that this Resolution shall only be effective at such time as the operating agreement between the District and the City of Costa Mesa is amended to provide for the services of the City Staff as needed to implement all of the provisions of this Resolution.
