BETWEEN COSTA MESA SANITARY DISTRICT AND S. GORDIN STRUCTURAL
DESIGN AND ENGINEERING SERVICES
THIS SECOND AMENDMENT to Agreement for structural engineering services
is made and entered into this / (P day of October, 2015, by and between the COSTA
MESA SANITARY DISTRICT, a sanitary district ("District") and S. Gordin Structural
Design & Engineering Services, a Nevada Corporation ("Consultant").
WITNESSETH:
WHEREAS, on January 15, 2014, the District and Consultant entered into an
Agreement ("Agreement") to perform structural engineering design services for District's
proposed block wall building for the 23`d Street sewer pump station's backup pump
installation ("Project"); and
WHEREAS, on March 19, 2015, the District and Consultant amended the
agreement because the scope of work changed to installing an emergency generator
instead of a backup pump; and
WHEREAS, the Consultant was to be paid the sum of $3,400 for services related
to the design of the backup pump station facility and did earn those fees and was paid
the same; and
WHEREAS, the City of Newport Beach plan check process required Consultant
to spend additional efforts on geotechnical issues related to the emergency generator
facility that were not considered in the original scope of work; and
WHEREAS, the Consultant has already performed the services as required by
the plan check process with District's consent; and
WHEREAS, District and Consultant have agreed upon the final balance due for
services rendered related to the changed project and agrees that an additional sum of
$2,520 is appropriate for these additional services; and
WHEREAS, the Agreement needs to be amended to increase payment due to
Consultant .
NOW, THEREFORE, the Agreement is amended as of the date hereof as
follows:
I . Section 4 in the Agreement shall be amended by increasing payment due
thereafter to compensate for continuing structural engineering design services and
identified in Consultant letter (Exhibit "A").
2. The District agrees to pay Consultant the additional sum of Two Thousand
Five Hundred Twenty Dollars ($2,520) for services already rendered.
3. The term of this Second Amendment shall become effective upon its
adoption.
4. Except as specifically amended by the terms of this Second Amendment,
all provisions in the First Amendment and the Agreement shall remain in full force and
effect.
IN WITNESS WHEREOF, the parties hereto have caused this Second
Amendment to be executed this day and year first above written.
