Our Einstien fuel tank supplier for the Yard misread the code and thought the diesel tank could be 7.5' from the property line so it was constructed 7.67’ from the property line, however, in reality it had to be 15’ from any building. Since the Hitch Crafter’s building next door is farther than 15’ from our diesel tank, the Board of Directors was apprised of the situation and determined that if and when a building next door was built within 15’ of our diesel tank, we will remove or relocate the tank. You can pass that on to Dave Hollister. He was kept in the loop but it appears he has forgotten our decision; please see the attached letter to him, which you can forward to him. The letter refers to recording a Covenant but the Board opted for just keeping the item in the records and not recording a Covenant. If any questions, Dave can approach Scott. Regarding the existing diesel tank, This is what I gather after talking with David Hollister : the plans for the diesel tank did not get routed to fire for plan check, The city is blaming the diesel tank contractor. Typically it is the city's responsibility to rout plans. I'm not sure exactly what happened after that other than according to Hollister it is still an open matter. One of the design build contractors showed their electrical engineering price of $6,800.00. We also spoke with David Hollister, CM Fire. He will allow the generator to be 5' from the prop line and 2'-3' from the building as long as the diesel tanks are under 275 gallons, Caterpillar and kohler are under that, and Cummins is at 344 gallons. Hollister also mentioned the existing diesel tank issue is still unresolved, Our understanding was it was resolved but David says he has nothing in writing as to the resolution, Do you have something we can send him?
