Reso 1959-100RESOLUTION N0. �0 0 RESOLUTION OF THE BOARD OF THE COSTA MESA SANITARY DISTRICT, ORANGE COUNTY, CALIFORNIA., ASCERTAINING AND DETERMINING THE PREVAILING RATE OF WAGES TO BE PAID FOR THE FOLLCPtr,IING PUBLIC IMPROVEMENT IN JOANN STREET AND CERTAIN OTHER STREETS IN SAID DISTRICT. WHEREAS., the Board of the Costa Mesa Sanitary District, Orange County, California, did, on the 5th day of February, 1959, adopt Resolution . of Intention No. 98 for the construction of sanitary sewers in Joann Street and certain other streets in said District, and appurtenances.and appurtenant work in connection therewith; and MIEREAS, pursuant to the provisions of Section 1773 of the Labor Code of the State of California,' it is necessary that said Board of the Costa Mesa Sanitary District ascertain and determine the general prevailing rate of wages on public works, and the provisions of said Code make it mandatory upon the awarding body of any public contract where said body subsequently calls for bid's for any public improvement to ascertain and determine the general prevail - irig rate of per diem wages in the locality in which the work is to be performed, for each craft or type;of workman or mechanic needed to execute the contract, and.also the general prevailing rate for legal.holiday and overtime work for each craft or type of workman or mechanic, NOWj, THEREFORE, the Board of the Costa Mesa Sanitary District., Orange County, California, has aseertaihed.and does hereby determine that the general prevailing rate of per diem wages in.the locality in which said work described is to be performed in the matter of certain public improvements for the construction of sanitary sewers and appurtenance's,'and` appurtenant work in connection therewith, in Joann Street and certain other.streets in.said_District, for each craft or type of workman or mechanic needed to execute the contract, and also the general prevailing rate for legal holiday and overtime work for each craft or t e of workman or mechanic in accordance with the schedule attached hereto. The rates of wages; including overtime,.holiday and.Sunday .rates, as just specified, are subject to the effect., if applicable thereto, of executive orders of the President of the United States No. 9240, dated Septem- ber` 9; 19112, ,and No. 9350, dated October 3, 1912, to any modifications thereof and to' any and all lawful 'orders of the President or any other authorized Federal Officer or Agency, ..insofar as • the same be applicable` to this con- tract.. In Case of-any inconsistency or omission,. the rates fixed by any such applicable Federal order, whether.higher or Iower,:shall.controlo In accordance with the provision of Section 1777.5•of ,the Labor'Code, as amended by Chapter 971, Statutes of'1939, and in accordance with the regu lations of the California Apprenticeship Coinicil, properly indentured appren- tices may.be employed in the.-.prosecution of this work. The above listed rates are based u on'a working day of eight (Q) hours, being proportionately applicable to eight (8) hours or less.of employ- ment in any one calendar day other than Saturdays, Sundays and the following seven legal holidays, to;wit:.•:.Nets Yearts Day, Memorial Day, Fourth; of July, Labor Day, Armistice Day,` Thanksgiving and Christmas, where any.work is re- qu red in case of extraordinary,emergency . caused . by fire,..flood or. danger to life or. property. . For any working time of.more than eight ($) hours in any one calendar day and for time.worked on Saturdays, Sundays and. any - of'the.- aforementioned holidays, not less than one and one-half-times the specified` `. i. . rates shall be paid .
