RESOLUTION CONFIRMING ASSESSMENT AS MODIFIED IN THE MATTER
OF THE INSTALLATION OF SANITARY SEWERS AND APPURTENANT WORK
IN ANNEXATIONS NOS. 21 and 22 TO THE COSTA MESA SANITARY
DISTRICT, ORANGE COUNTY, CALIFORNIA.
WHEREAS, there has been filed tiri.th the Secretary of the Costa
Plesa Sanitary District, Orange County, California, an assessment to represent
the costs and expenses of the work and improvement done pursuant to proceedings
had and taken under and pursuant to Resolution of Intention No. 23, adopted
by the Board of said Sanitary District on the 7th day of June, 1956; and
WHEREAS, the Secretary has duly given notice in the manner provided
by law of the filing of said assessment and of the time set for hearing; and
WHEREAS, a hearing was duly and regularly held upon said assessment
as provided by law; and
WHEREAS, this Board has by Resolution ordered certain changes and
modifications in said assessment; and
WHEREAS, said changes and modifications have been made in accordance
with the direction of this Board; and
WHEREAS, this Board is now satisfied as to the proper completion
of the work and of the spreading of the assessment.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE BOARD OF THE COSTA
MESA SANITARY DISTRICT, ORANGE COUNTY, CALIFORNIA, AS FOLLOWS:
SECTION 1. That the said assessment and diagram, as modified, and
the proceedings leading up to the same, and all acts and determinations of all
officers of said Sanitary District, in relation to the work done and to the
said assessment and the diagram attached thereto be, and the same hereby are,
ratified and confirmed, and the Engineer of said Sanitary District is hereby
ordered and directed to attach to said assessment a warrant in the manner and
form provided by law, said warrant bearing date of this Resolution, and is
further ordered to deliver said warrant, diagram and assessment to the
contractor, or his assignee, as the case may be, forthwith upon payment of
the incidental expenses due thereon.
