Reso 1950-12^W RES. AM olA RESOLUTION RESOLUTION OF THE GOVERNING BOARD OF COSTA MESA SANITARY DISTRICT PROVIDING FOR ISSUANCE OF BONDS AND FIXING DATE OF SALE. WHEREAS, an election was duly and regularly held in Costa Mesa Sanitary District on the 15th day of August, 1950, at which the question of issuing and selling bonds of said district in the amount of eight hundred fifty thousand dollars ($850,000.00) for the purpose of raising money for the following purpose, towits The acquisition and construction of a system of trunk and lateral sewers, including the acquisition of all easements and other property necessary therefor' was submitted to the qualified electors of said Costa Mesa Sanitary District; and WHEREAS, not less than two - thirds of the qualified voters voting at said election voted in favor of issuing such bonds and said propostion carried; VOW, THEREFORE, the Governing Board of Costa Mesa Sanitary District DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows:. Section 1. That bonds of Costa Mesa Sanitary District in the amount of eight hundred fifty thousand dollars ($850,000.00) be issued and sold for the purposes hereinabove recited. Said bonds shall be dated March 1, 1951, and shall be eight - hundred fifty in number, numbered 1 to 850, inclusive, of the denomination of $1,000 each. Said bonds shall mature in consecutive numerical order, $25,000 on March 1 in each of the years 1962 to 1981, inclusive. Said bonds shall bear in- terest at a rate or rates not to exceed six per cent (6 %) per annum, payable semi- annually. Section 2. That said,bonds and the interest thereon shall be payable in idw- ful money of the United States of America at the office of the County Treasurer of Orange County. Said bonds shall be signed by the President of this board, and shall be countersigned by the Secretary of this board, who shall affix thereto the seal of said district. The coupons on said bonds shall be signed by the facsimile signatures of said officers. The coupons of said bonds shall be numbered consecutively and shall bear the number of the bond to which they are attached. Said bonds and the coupons thereon shall be substantially in the following form, to -wit: UNITED STATES OF AMERICA STATE OF CALIFORNIA COUNTY OF ORANGE Costa Mesa Sanitary District Bond, 1951 No. Costa Mesa Sanitary District, a public corporation duly organized and existing under and by virtue of the laws of the State of California, situated in the County of Orange, State of California, for value received, hereby acknowledges its indebtedness and promised to pay to the bearer hereof, at the office of the Treasurer of Orange County, in the City of Santa Ana, California, the sum of One Thousand Dollars ($1,000) in lawful money of the United States of America on the first day of March, 19 , with interest thereon in like lawful money at the rate of per cent ( %) per annum, payable semiannually on the first day of March and the first day of September of each and every year from the date hereof until this bond is paid, on presentation and surrender of the respective interest coupons hereto attached. This bond is issued by said Costa Mesa Sanitary District under and in pur- suance of and in conformity with the provisions of Part 1 of Division VI of the Health and Safety Code of the State of California, sometimes known as the "Sani - tary District Act of 1923," and in pursuance of the laws and Constitution of the State of California, and is authorized by a vote of not less than two- thirds of all the qualified electors of said Costa Mesa Sanitary District voting at an election duly and legally called, held and conducted in said district on the 15th day of August, 1950. IT IS HEREBY CERTIFIED, RECITED AND DECLARED that all acts, conditions and things required by law to exist, happen and be per- formed, precedent to and in the issuance of this bond have existed, happened and been performed in due time, form and manner and as required by law, and that the amount of this bond together with all other indebtedness of said district does not exceed any debt limit prescribed by the laws or Constitution of the State of California'. IN WITNESS WHEREOF, said Costa Mesa Sanitary District has caused this bond to be signed by the President and countersigned by the Secretary of the President and countersigned by the Secretary of the Governing Board of said district and sealed with the corporate seal of said district this lst day of March, 1951.
