18 - Grant of Easement Costa Mesa Sanitary District …an Independent Special District Protecting our community’s health and the environment by providing solid waste and sewer collection services. www.cmsdca.gov Memorandum To: Board of Directors Via: Scott Carroll, General Manager From: Rob Hamers, District Engineer Date: October 24, 2013 Subject: Grant of Easement to Costa Mesa Sanitary District for a Standby Diesel Generator at Canyon Lift Station – Project #196-B Summary The goal of Project #196 is to provide backup power and backup pumping capability at six critical lift stations. The Irvine and Canyon pumping stations will have standby diesel generators and the Elden, Victoria, Mendoza and 23 rd pumping stations will have backup pumping units. An easement for the generator and conduit is needed from two private property owners at the Canyon lift station, and enclosed for Board consideration is the proposed agreement with these two property owners. Staff Recommendation The Board of Directors approves and executes the easement agreement. Analysis District staff is challenged with the new reality that Southern California Edison power is not as reliable as in years past. This project will provide a standby diesel generator at the Canyon lift station until such time as the station is abandoned as part of the west side abandonment project. At that time, the generator will be relocated to another pumping station. ITEM NO. 18 Board of Directors October 24 , 2013 Page 2 of 3 The attached agreement represents successful negotiations with the two property owners where the generator and conduits will be constructed. The compensation for the 5 -year period of the agreement is a one -time payment of $5,000 to the owner of 2247 State Avenu e and a one -time payment of $3,1 00 to the owner of 2250 Canyon Drive. Should delays in the abandonment project occur, the District an d the property owners will negotiate the extension in good faith. The construction plans for the new generator were placed out to bid on October 9, 2013 and bid opening is scheduled for November 5, 2013. Strategic Plan Element & Goal This item complies wi th the objective and strategy of Strategic Plan Element 1.0, Sewer Infrastructure , which states as follows : ”Objective: Our objective is to collect and transport wastewater to meet the needs of existing and future customers. Strategy: We will do this by the careful management of the collection infrastructure using prudent planning and maintenance, with financial strategies to maintain sufficient capacity and respond to changing regulatory demands.” Legal Review This easement agreement was prepared and s igned by the Associate District Counsel. Environmental Review The installation of a backup generator is categorically exempt under the California Environmental Quality Act (CEQA) (Public Resources Code Section 21000 et. s eq.) under Section 15301 as a “Class 1” “minor alteration of existing public or private structures”, as further described in S ection (b) as “Existing facilities of both investor and publicly -owned utilities used to provide …. sewerage …” Financial Review The total cost to compensate t he two property owners is $8,100 . The cost associated with this lease agreement will be included in the overall project cost, which has a current balance of $995,388 .
