Contract - Willdan Engineering - 2013-07-01 FIRST AMENDMENT TO AGREEMENT
BETWEEN COSTA MESA SANITARY DISTRICT AND WILLDAN ENGINEERING
FOR PERMIT TECHNICIAN COUNTER SERVICES
THIS FIRST AMENDMENT to Agreement between the Costa Mesa Sanitary District and Willdan
Engineering for permit technician counter services ("AGREEMENT") is made and entered into this
/ day of , 2013, by and between the Costa Mesa Sanitary District, hereinafter
referred to as DISTRICT, a Willdan Engineering, hereinafter referred to as CONSULTANT.
WITNESSETH:
WHEREAS, on February 19, 2013, the DISTRICT and CONSULTANT entered into AGREEMENT for
permit technician counter services; and
WHEREAS, the DISTRICT requires the CONSULTANT to amend the scope of services outlined in
the AGREEMENT to meet the needs of the DISTRICT, and
WHEREAS, the amended scope of services to be performed is described in Exhibit "A" attached
hereto; and
WHEREAS,the DISTRICT and CONSULTANT now desire to amend the AGREEMENT to change the
scope of work and increase CONSULTANT's compensation for services rendered.
NOW,THEREFORE,the parties hereto agree as follows:
1. Section 5 (a) in the ORIGINAL AGREEMENT shall be amended by eliminating the
following language:
"DISTRICT agrees to pay CONSULTANT forty five dollars($45.00) per hour. This amount shall not
exceed twenty eight thousand eight hundred Dollars ($28,800.00) for the total term of this AGREEMENT
unless additional payment is approved as provided in this AGREEMENT."
and adding the following language:
"DISTRICT agrees to pay CONSULTANT forty seven dollars and twenty five cents ($47.25) per
hour."
2. Exhibit A in the AGREEMENT shall be amended by removing the following tasks:
• Assign and provide a well-qualified engineering permit technician to serve on a
temporary basis as an independent contractor to the DISTRICT for a minimum of 4
months.

• Within the first 2 months of service,the Permit Technician will provide an analysis of the
current job procedures and recommendations for changes to either streamline the
operation or update the procedures to meet current business practices.
• Within the last 2 months of service,the Permit Technician will implement the approved
recommendations and begin training the assigned permanent employee for transition
into the position.
3. Exhibit A in the AGREEMENT shall be amended by adding the following tasks:
• Assign and provide a well-qualified engineering permit technician to serve on a
temporary basis as an independent contractor to the DISTRICT.
• Permit Technician will perform duties necessary to update the DISTRICT's annual
assessment charges for revenue generation using methods and procedures developed
by CONSULTANT. DISTRICT shall not control or direct the work of CONSULTANT.
• Permit Technician will implement approved recommendations for changing the Permit
Office operating procedures to either streamline the operation or update the
procedures to meet current business practices.
4. The term of this First Amendment shall run concurrently with the AGREEMENT.
5. Except as specifically amended by the terms of this First Amendment, all provisions of
the AGREEMENT shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this First Amendment to be executed
this day and year first above written.

EXHIBIT A
Scope of services:
• Assign and provide a well-qualified engineering permit technician to serve on a
temporary basis as an independent contractor to the DISTRICT.
• Permit Technician to be stationed at the District Headquarters public counter
Monday through Thursday 7:30 am to 4:00 pm and Friday 7:00 am to 3:30 pm
o Permit Technician will receive and process District permit applications
using methods and procedures developed by CONSULTANT at the
District Headquarters. DISTRICT shall not control or direct the work of
CONSULTANT
o Permit Technician will collect plan submittals from the City of Costa Mesa
and process in the manner developed by CONSULTANT
o Permit Technician will provide public information and general
administrative support
• Permit Technician will perform duties necessary to update the DISTRICT's
annual assessment charges for revenue generation using methods and
procedures developed by CONSULTANT. DISTRICT shall not control or direct
the work of CONSULTANT.
• Permit Technician will implement approved recommendations for changing the
Permit Office operating procedures to either streamline the operation or update
the procedures to meet current business practices.
