Subject: Approve the Fourth Addendum to the Agreement with Environmental
Engineering and Contracting, Inc. for Continuing the District’s Fats, Oil,
Grease (FOG) Program
Summary
On June 21, 2010, the Board approved an agreement with Environmental Engineering and
Contracting, Inc. (EEC) to develop and manage a Fats, Oil and Grease (FOG) Control
Program. The agreement with EEC expire d on June 30, 201 3 .
Staff Recommendation
That the Board of Directors approves the Fourth Addendum to the Agreement with
Environmental Engineering and Contracting, Inc. for Continuing the District’s Fats, Oil,
Grease (FOG) Program .
Analysis
During the past three years, EEC has been responsible for providing FOG Control
Program management activities such as database and GIS management, program
assessment and recommendations, FOG source investigation oversight and support as
well as other related support activities. However, the primary source of service by EEC is
conducting inspections at food service establishments. Listed below is the total number
inspections performed by EEC during the past year.

Of the 198 total grease control devices inspected 77 were not incompliance for FOG and
required a follow -up. Any facility requiring additional enforcement actions such as multiple
follow -up inspections are described below.
Cabo Grill Interceptor – 4/30/2013 inspection identified grease interceptor water
levels high. Required to hydro -jet effluent line. C&R Drains cleared blockage.
California Wok – 7/18/2012 inspection identified baffle wall missing. Requi red
multiple compliance inspections to gain compliance. Facility in compliance during
4/26/2013 inspection.
El Metate Market – 11/27/2012 inspection identified FOG percentage above
25%. Required multiple compliance inspections to gain compliance. Facili ty in
compliance during 4/24/2013 inspection.
Charo Chicken – 10/15/2012 inspection identified FOG percentage above
25%. Required multiple compliance inspections to gain compliance. Facility in
compliance during 2/7/2013 inspection.
Ramen Yamadaya – 7/2 7/2012 inspection identified FOG percentage above
25%. Required multiple compliance inspections to gain compliance. Facility in
compliance during 11/30/2012 inspection.
Thai Spice – 11/27/2012 inspection identified FOG percentage above
25%. Required mul tiple compliance inspections to gain compliance. Facility in
compliance during 5/28/2013 inspection.
Ruby’s Diner – 3/4/2013 inspection identified FOG percentage above
25%. Required multiple compliance inspections to gain compliance. Facility in
compliance during 5/7/2013 inspection.

FOG is now the number one cause for sanitary sewer overflows (SSOs ), so it is important
that the District continues inspecting and enforcing food service establishments for
implementing best management practices. As you can see in the amount of inspections
performed above, the District does not have the adequate staff or resources to manage
this part of the prog ram in -house. During the first six months of 2013, the District did not
experience an SSO caused by FOG fr om a food service establishment .
As a result of EEC’s performance, staff is recommending their contract be ext ended for an
additional two years, expiring on June 30, 2015 . According to District Operations Code
Section 4.04.070(f), no agreement or contract shall extend for a period of more than five
years, except for trash and recycling contracts and professional services contract for those
persons serving as District Officers (e.g. General Manager, District Engineer, District
Counsel and District T reasurer). In January 2015, staff will solicit bids for managing the
District’s FOG Program.
EE C’s cost will increase slightly by 4.28% from $99,733 to $104,000 .
Strategic Plan Element & Goal
This item supports achieving Strategic Element 1.0, Sewer Inf rastructure and Strategic
Goal No. 1.8, Fats Oil Grease (FOG) Program.
Legal Review
Deputy District Counsel has reviewed and approved the Fourth Addendum to Agreement.
Financial Review
The cost to continue the FOG program is $104,000 . In the FY 2013 -14 Budget, $104,000
is allocated for this program. In the FY 2014 -15 Budget, $107,000 is allocated for this
program.
Public Notice Process
Copies of this report are on file and will be included with the entire agenda packet for the
July 31 , 2013 Board of Directors regular meeting at District headquarters and on District’s
website.
