Attachment A 1.SubscriberComplianceCertification SubscribercertifiestoHireRightasfollowswithrespecttoeachFCRA-regulatedScreeningReportSubscriberordersand/orreceives:1.Permissible Purpose.SubscribershallprocureanduseScreeningReportsonlyforthelegallypermissiblepurposessetforthinthe Agreement.2.Applicant Disclosure and Consent.Subscriberwillensurethat prior toitsprocurementofaScreeningReportfor employment purposes:(i)SubscriberhasmadeaclearandconspicuousdisclosureinwritingtotheApplicant,inadocumentthatconsistssolelyofthedisclosure,thata consumerreportmaybeobtainedforemploymentpurposes(andforCaliforniaApplicants,thedisclosureshallalsoincludethename,address andtelephonenumberofHireRight,thenatureandscopeoftheinvestigationrequested,asummaryoftheprovisionsofCa.CivilCodeSection 1786.22,andotherwisecomplywithCa.CivilCodeSection1786.16);and(ii)theApplicanthasauthorizedinwritingtheprocurementofthe ScreeningReportbySubscriber(andforCA,OKandMNApplicants,SubscribershallprovidetheApplicant,bymeansofacheckbox,an optionbywhichtheApplicantmayindicateontheirwrittenconsentformthattheApplicantwishestoreceiveacopyofanyScreeningReport thatisprepared).3.Pre-Adverse Action Disclosures.InusingaScreeningReportfor employment purposes,beforetakinganyadverseactionbasedinwholeor inpartontheScreeningReport,SubscribershallprovidetotheApplicanttowhomtheScreeningReportrelates:(i)acopyoftheScreening Report;and(ii)adescriptioninwritingoftherightsoftheApplicantundertheFCRA,asprescribedbySection609("SummaryofConsumer Rights"),andanyothernoticesrequiredbyapplicableLaws.4.Adverse Action Disclosures.AfterprovidingtheApplicantwiththepre-adverseactiondisclosuredescribedinparagraph3above,andafter SubscriberhasgiventheApplicantreasonabletimetodisputetheinformationcontainedintheirScreeningReport,Subscriberwill,ifintendingto takeadverseactionwithrespecttotheApplicantbasedinwholeorinpartoninformationcontainedintheScreeningReport,sendtheApplicant afollow-upnotificationthattheSubscriberistakingadverseaction(e.g.,denyingemploymentorpromotion)basedinwholeorinpartonthe informationcontainedintheScreeningReport.5.EEO Compliance.TheinformationfromtheScreeningReportwillnotbeusedinviolationofanyapplicablefederalorstateequalemployment opportunitylaworregulation.6.Investigative Consumer Reports.ForeachInvestigativeConsumerReport,asdefinedbytheFCRA(e.g.,professionalreferencecheck),that SubscriberprocuresfromHireRight,SubscriberhascompliedwithitsobligationsunderFCRASection606(a)and(b),including,without limitation,thefollowing:a)clearlyandaccuratelydisclosingtotheApplicantthatanInvestigativeConsumerReportincludinginformationastotheApplicant'scharacter,generalreputation,personalcharacteristics,andmodeofliving,whicheverareapplicable,maybemade,andsuchdisclosure:i)ismadeinwritingmailed,orotherwisedelivered,totheApplicantnotlaterthanthreedaysafterthedateonwhichthereportwasfirst requested;and ii)includesastatementinformingtheApplicantofhisrighttorequesttheadditionaldisclosuresprovidedforunderFCRASection606(b)asset forthin(b.)below,andawrittenSummaryofConsumerRights;and b)uponwrittenrequestmadebytheApplicantwithinareasonableperiodoftimeafterthereceiptbyhimofthedisclosurerequiredinparagraph 6.a.(i)above,Subscriberwillmakeacompleteandaccuratedisclosureofthenatureandscopeoftheinvestigationrequested.Thedisclosure willbemadeinawritingmailed,orotherwisedelivered,totheApplicantnotlaterthanfivedaysafterthedateonwhichtherequestforsuch disclosurewasreceivedfromtheApplicantorsuchreportwasfirstrequested,whicheveristhelater.2.Information Access and Security Requirements 1.SubscribershallprotectitsHireRightaccountidentificationnumber(s)andpassword(s)("AccountI.D.'s")sothatonlykeySubscriber personnelwithanauthorizedneed-to-knowthissensitiveinformationaregiventheabilitytoorderandaccessScreeningReports.Subscriber shallnotpostorotherwisepubliclydisplayitsAccountI.D.'s.IfapersonwhoknowstheAccountI.D.'sleavesSubscriber'scompanyornolonger needstohaveaccessduetoachangeinduties,theAccountI.D.'sshouldbechangedimmediately.2.SubscribershallplaceallterminaldevicesorsystemsusedtoobtainScreeningReportsinasecurelocationwithinSubscriber'sfacilitysothat unauthorizedpersonscannoteasilyaccessthem.Afternormalbusinesshoursorwhenleftunattended,besuretoturnoffand/orlockallsuch devicesorsystemsusedtoaccessScreeningReports.3.SubscribershallsecurehardcopiesandelectronicfilesofScreeningReportswithinSubscriber'sfacilitysothatonlyauthorizedpersonnelcan accessthem.4.Subscribershallshredorotherwisepermanentlydestroyall hardcopy ScreeningReportswhennolongerneededandwhenapplicable regulation(s)permitdestruction,topreventtheunauthorizedaccesstoand/oruseofapplicant/employeedataand/oranyotherpersonally identifiableinformationofapplicants/employees.5.Subscribershalleraseandoverwriteorscramble electronicfiles containingScreeningReportsandApplicantinformationwhennolonger neededandwhenapplicableregulation(s)permitdestruction,topreventtheunauthorizedaccesstoand/oruseofapplicant/employeedata and/oranyotherpersonallyidentifiableinformationofapplicants/employees.6.SubscribershallmakeallappropriateemployeesawarethatSubscribercanorderanduseScreeningReportsonlyforpermissible employmentpurposes,andthatemployeesmaynotordertheirownreportsnorshouldtheyorderoraccessthereportofafamilymemberor friendunlessitisapprovedforthepermissibleemploymentpurposeauthorizedin,andconductedinaccordancewiththisAgreement.7.IfSubscriberobtainsVerificationServicesorScreeningReportscontainingconsumercreditinformationfromHireRight,Subscribershall,in additiontoitsotherobligationsinthisAgreement,complywiththe"AccessSecurityRequirements"availableforviewingat http://www.hireright.com/service-agreement.aspxandherebyincorporatedbyreferenceintothisAgreement.Subscriberacknowledgesthatthe AccessSecurityRequirementsaremandatedbyHireRightSupplier(s)andmaybeupdatedfromtimetotime.ByexecutingthisAgreement,SubscriberrepresentstoHireRightthatSubscriberhasreviewedandwillcomplywiththeAccessSecurityRequirementstotheextentapplicable
