Minutes - Board - 1970-05-27MINUTES OF THE REGULAR ADJOURNED MEETING BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT HELD AT 77 FAIR DRIVE 0 ROLL CALL Scholz Homes • May 27, 1970 PRESENT: Directors - Briggs, Rime, Glockner, Warren, and Porter ABSENT: Directors - None Officials Present: Manager Madsen, Director of Finance Oman, Attorney June, Engineer Stevens, Director of Streets and Parkways Bogart, and Assistant Secretary Angel The Board of Directors of the Costa Mesa Sanitary District met in adjourned regular session atN7:30 p.m., May 27, 1970, at the City Hall, 77 Fair Drive, Costa Mesa, Cali- fornia, having adjourned by order of the Board of Directors at its regular adjourned session of May 20, 1970. A copy of the notice of adjournment was posted and delivered as required by law. The meeting was called to order at 7:30 p.m. by President Porter. The following persons were present representing the City of Newport Beach: Mayor E. F. Hirth J. T. Devlin, Director of Public Works T. Seymour, City Attorney Larry Wilson, Planning Director Councilman Lindsley Parsons The following persons were present representing Scholz Homes, Inc.: Chet Stare, Vice President Mr. Stanley Gorzewski Tom Peckenpaugh, Attorney Robert Vatcher, Engineer (VTN) Attorney June stated that at the conclusion of the last meeting it was understood that the City of Newport Beach would meet with the representatives from Scholz Homes, Inc. to try and solve the problems involved with the proposed development of the Scholz Homes property located on the southeast corner of Superior Avenue and Hospital Road. Mr. Seymour stated a meeting was held and he felt a great • deal of progress was made, and at this time he submitted a letter directed to the Costa Mesa Sanitary District. - 2 - Article on President Porter asked if he might address the repre- proposed sentatives from Newport Beach before discussing the • annexation to contents of the letter. Newport Beach of McDonnell President Porter mentioned the newspaper article in the Douglas Pro- Daily Pilot about the proposed annexation to Newport perty mentioned Beach of the McDonnel Douglas Corporation property west of Orange County Airport. At this time Councilman Parsons addressed the Board stating that the City of Newport Beach intends to keep its promise to the City of Costa Mesa regarding the boundary line along Tustin Avenue. Councilman Parsons stated the City of Newport Beach will take no action to negate its agreement with the City of Costa Mesa. He mentioned that the people interested in annexing this property have taken it to the Local Agency Formation Commission. Scholz Homes In the letter submitted by Newport Beach the following Property comments were made regarding annexation of the Scholz (continued) Homes property to the City of Newport Beach: 1. Annexation proceedings could be completed within 60 days from the date on which the developer files his petition for annexation to Newport Beach. 2. City of Newport Beach is prepared to provide • water and sewer service to the Scholz Homes development, based upon interim service contracts pending completion of the annexation, and to have the developer process his building permits through the County Building Department. The terms and conditions under which the City of Newport Beach would annex this property was outlined in the letter as follows: 1. The City will accept an application to pre -zone the territory to be annexed to a zoning classi- fication which would allow the type of apartment project proposed by the developer; and the City will work with the developer to arrive at mutually satisfactory parking requirements. 2. Payment by the developer of the City's Building Excise Tax which is used to finance construction of parks, libraries and fire stations. 3. Payment utility President Porter . would have to be and the logical is developed. by the developer of any applicable City connection fees. stated that eventually this property annexed to the City of Newport Beach, time would be at the time the property G • - 3 - Scholz Homes Representatives from Scholz Homes stated they were happy (continued) with the results of their meeting with the staff of the City of Newport Beach; however, they were still concerned with meeting their deadlines in the first phase of their development. They stated further the desire to still be able to call upon the Costa Mesa Sanitary District Board in the event problems arise. Attorney June asked when construction was scheduled to begin. Mr. Devlin mentioned that the developer would be responsible for installing all the sewers. However, he stated it would be possible to protect the developer through a reimbursement agreement, so that developers wishing to connect to the sewers in the future would be responsible for paying their pro rata share for the cost of these lines. After discussion, the Board informed the representatives present as follows: The Board does not wish to enter into service contracts with developers as private indi- viduals. Any service contract will be with the munici- pality involved. Mr. Peckenpaugh asked if they would be able to come back to the Board with the Scholz Homes original request if they run into difficulty. President Porter stated they would discuss a service contract only with the City of Newport Beach, or with the City of Newport Beach and Scholz Homes, Inc. jointly.
