Acceptance of Improvements
Summary
Construction of the improvements was completed on June 28, 2012, therefore, it is
appropriate for the District to accept the improvements and file a Notice of Completion.
Staff Recommendation
That the Board of Directors approves the following action:
1. Accept improvements as completed and file a Notice of Completion.
2. Authorize payment of 5% retention 35 days after Notice of Completion
is recorded.
3. Exonerate Labor and Material Bond after Notice of Completion is
recorded and exonerate Faithful Performance Bond one year of Notice of
Completion is recorded.
Analysis
The rezoning of the east Santa Ana Heights area as part of the John Wayne Airport
land use plan required the District to upsize the existing sewer line in Bristol Street to
provide additional capacity. The sewer construction is being funded by the Orange
County Development Agency (OCDA), the redevelopment arm of the County, as part
of a three -party agreement between OCDA, the City of Newport Beach, and the Costa
Mesa Sanitary District (CMSD).

The project was divided into two phases when it was discovered during the original
project that a 12 -inch asbestos cement water line belonging to the Irvine Ranch Water
District (IRWD) was only 3.5 feet from the sewer main. Construction would likely
cause the water line to move, thereby causing the brittle asbestos cement pipe to
crack, and possibly burst. The water line location was not as indicated on record plans
provided by IRWD, however, IRWD acquired the line as part of their acquisition of the
old Santa Ana Heights Mutual Water Company.
The contractor for the original project constructed two- thirds of the main and stopped
at the point where the 12 -inch water line interfered with the sewer construction. The
remaining one -third of the sewer main (700 linear feet) was redesigned and rebid
using the no -dig technology pipe bursting..
Pipe bursting consists of pulling a bursting head that pulverizes the existing pipe and
pushes the pieces outward into the existing soil while pulling the new line into place.
The District pipe bursted the existing 8 -inch sewer with a new 12 -inch sewer.
Strategic Plan Element & Goal
This item complies with Strategic Plan Element 1.0, Sewer Infrastructure and Goal No.
1.4 System Wide . Sewer Replacement and Repair Program. The strategy for this
Strategic Element is
"We will do this by .the careful management of the collection infrastructure using
prudent planning and maintenance, with financial strategies to maintain sufficient
capacity and respond to changing regulatory demands."

The Attorney for the District prepared the construction contract for the work.
Financial Review
The total construction contract with Repipe -CA, Inc. is in the amount of $299,700,
including the retention in the amount of $14,985.
The engineering design and contract administration /inspection costs paid, or estimated
to be paid to Robin Hamers & Associates are $42,707 and $32,193 respectively for a
total of $74,900.
Project #129 incurred the following additional costs:

In summary the total project costs are estimated at $401,661. The total approved
budget for Project #129 Bristol Street Sewer Phase II is $634,324, therefore Project
#129 is projected to be under budget by approximately $232,663.
The construction costs and the contract administration costs are to be funded by the
successor to the Orange County Development Agency (OCDA). The District will be
submitting a claim for reimbursement to OCDA for approximately $351,497 comprised
of $317,947 for construction costs and $33,550 for contract administration costs.
