Dear Sir
At the time that you applied for sewer service from the Costa Mesa Sanitary
District the District was contemplating the adoption of a user fee to be
collected by the County Treasurer, along with the semi -annual real property
tax payments
The District was not prepared to provide sewer service for your project at
the time because of financial constraints and as a solution and in order
to provide you with sewer service and to meet your development schedules
a contract was entered into between you and the Costa Mesa Sanitary District
entitled Agreement and Restrictive Covenant
This contract provided under paragraph XVI beginning on page 11 that the
agreement would be effective until such time as the assessment district
had been completed and your property placed on the assessment roll for
the imposition of the appropriate fees to pay for the services rendered
by the District and as provided for in the agreement
The assessment district assessing a user fee was completed and the charge
for sewer services now appears on the semi -annual real property tax state-
ment from the County of Orange
Although it is the opinion of this office that the above-mentioned con
tract has expired by its own terms the Board nevertheless felt that as a
housekeeping measure and that as property owners being served you should
be advised of this fact and should acknowledge the termination of the
agreement Accordingly this letter is submitted in duplicate along
with a stamped self-addressed envelope for your convenience acknowledging
the termination of the agreement pursuant to its terms as heretofore set
forth
