Subject: Ordinance Enforcement Report
This report summarizes major points for three ordinance enforcement topics covering
Scavenging, Graffiti, and Trash Container Enforcement.
Scavenging: In the month September, there were no calls to the District HQ to report
scavenging activity. However, there were incidents I observed directly; the scavenging
incidents listed below were not individuals who are trying to make a business from
recycling materials. No citations were given.
Also, I have been in communication with Frank Campos (CR&R-Route Manager) and
CR&R drivers to try and pinpoint locations that are consistently being target by
scavengers.

Graffiti (Update): CR&R's maintenance crew continues to remove graffiti from trash
bins on the 600-700 Blocks of Hamilton Street and the 2000 block of Wallace Ave.
Trash Container Enforcement: In the month of September, there were two
complaints that came into the District HQ to report addresses that leave their trash
bins (t/b) in public sight (p/s). I made a site visit to each address:

I will continue to go back and monitor both locations as well as previous locations to
ensure compliance.
In addition, a resident living in the 2180 block of Elden Ave (between 22nd & Tulip Ln)
requested I target the area for residents leaving their t/b out on the curb. I made a site
visit on 9/7/2011, and found approximately 10 t/b in p/s. I spoke to several of the
residents in the area and informed them of the Districts' policy. I went back on
9/15/2011 on found all t/b had been placed out of public sight. Again, I will continue to
monitor the area.
A summary of the courtesy notice process for the District OEO is provided in the
following chart and demonstrates the effectiveness of a "1St Notice":

Subject: Status Report and Action Plan for OC Waste and Recycling Grant
In Fiscal Year 2009110, the Costa Mesa Sanitary District, City of Costa Mesa, and the
City of Huntington Beach received $142,256 from OC Waste and Recycling for the AB
939 Regional Recycling and Waste Diversion Grant program. The purpose of this
memo is to provide an overview on the progress made thus far as well as an action
plan for the next six months. The information provided is current as of September 30,
2011. This grant has been extended until December 31, 2013.

Accomplishments
Dr. Francene Kaplan has presented 25 composting workshops since September 2010
including 9 schools, 7 community events, and 9 workshops at the Orange County Fair.
This summer marks the first year the CMSD participated at the OC Fair where the
Centennial Farms Coordinator boasted Francene's workshops attracted a record
attendance of over 340 people in 4 weeks! Overall, the workshops have been very
successful educating 823 students, teachers and members of the community on the
benefits of composting.
Action Plan
Schools
• FAX a flyer to all schools once a month to promote the program
• Send emails to specific teachers in subjects such as Science or Environmental
Studies
• Approach the Newport Mesa Unified School District to request permission to
attend District wide department meetings to discuss the composting program
with teachers on Staff Development Days or In Service Days
• Target after school programs such as YMCA or Boys and Girls Clubs for
workshops
• Reach out to Inside the Outdoors and Green Up Our Schools to partner with
them on their current composting efforts in Costa Mesa schools
Residents
• Provide composting workshops for the community at a rate of one per month
• Four workshops are scheduled for February 25, March 11, April 1, and May 5 at
Fairview Park next to Estancia High School
• Flyers will be placed at the Costa Mesa City Hall, Huntington Beach City Hall,
and the CMSD front counter to promote the events
• Advertising will take place in the CMSD Newsletter, OC Register and Daily Pilot,
Penny Saver, Z Vents, OC Register Home & Garden Section, Mother's Markets
Bulletin Board and the CMSD Website
Residential FOG Program
• Collection Event held at Orange Coast College Recycling Center scheduled to
run from November 21 thru January 6.
• Purchased 125 FOG Funnels as giveaway items to promote the event
• Promoted in the CMSD newsletter, the CMSD website, an insert in the
November and December Mesa Water bill, and KTLA Channel 5 News (still
pending)

Subject: Draft Ordinance Prohibiting Unauthorized Use of Trash Containers
Summary
Attached is an ordinance that amends Chapter 7.01 of the Operations Code pertaining
to trash regulations. The Ordinance clearly defines the unauthorized use of another
person's trash container without expressed written permission from the owner or legal
possessor of the container. This revision also gives the District strong enforcement
powers against any individual found violating the code.
Staff Recommendation
That the Recycling Committee recommends the Board of Directors adopts the
attached ordinance prohibiting unauthorized use of trash containers.
Analysis
District staff has received numerous complaints regarding inappropriate or
unauthorized use of trash containers in the community. The proposed ordinance will
allow the CMSD to assist those who wish to address the misuse through a formal
process. Residents must provide proof of the violation through pictures or video
submitted to the CMSD Office. A citation will also be issued if the CMSD Code
Enforcement Officer witnesses the incident.
Strategic Element & Goal
This item supports achieving Strategic Element No. 5.0, Administrative Management,
which states: "Our objective is to create, maintain and implement policies and
procedures to ensure sound management of the District."

Legal Review
The attached document is a draft ordinance. It still needs to be reviewed and
approved by District Counsel before the Board considers it for approval.
Financial Review
Adopting the revisions to the Operations Code will have no financial impact to the
District. Issuing citations to those violating this Ordinance could generate some
revenue, however, the CMSD Code Enforcement Officer would have to provide proof
of the alleged act to enforce compliance.
Alternative Actions
Refer the matter back to staff for additional information.

ORDINANCE NO.
AN ORDINANCE OF THE COSTA MESA SANITARY
DISTRICT AMENDING CHAPTER 7.01 OF THE
OPERATIONS CODE PERTAINING TO TRASH REGULATIONS
WHEREAS, the Board of Directors has previously established regulations with regard to
standardized trash containers; and
WHEREAS,the District provides trash containers to residents receiving residential solid
waste collection services; and
WHEREAS, some residents are depositing their solid waste in another person's trash
containers instead of their own containers; and
WHEREAS, the Board desires to discourage this type of activity from residents by
adopting and enforcing local regulations; and
WHEREAS, the Board has the authority to adopt and enforce such regulations in the
community; and
WHEREAS, the Board believes it will be in the District's best interest to adopt an
ordinance that would make it illegal for any person to deposit solid waste in another person's
trash containers.
NOW, T-HEREFORE, the Board of Directors of the Costa Mesa Sanitary District does
hereby ORDAIN as follows:
Section 1. That Chapter 7.01 of the Costa Mesa Sanitary District Operations Code is hereby
amended by adding the following section to read as follows:
"07.01.090 Unauthorized use of containers. It shall be unlawful for any person to deposit
solid waste in a container owned or legally possessed by another person in any place, public or
private, without the written permission of the owner or legal possessor of the container."
Section 2. Should any part, clause or section of this Ordinance be declared by any Court of
competent jurisdiction to be invalid, the remaining provisions of this Ordinance shall nevertheless
be and remain in full force and effect and the Board of Directors of the Costa Mesa Sanitary District
of Orange County, California, hereby declares that each and every section, clause, provision or part
of this Ordinance would have been adopted and made a part of this Ordinance without the adoption
of any portion thereof and that the invalidity of any part or provision hereof shall not in any way
affect the validity or enforcement of the remaining provisions of this Ordinance that may stand on
their own.
Section 3. Pursuant to Health and Safety Code Sections 6490 and 64913, the District Clerk shall
cause this ordinance or a summary thereof to be published in a newspaper of general circulation
printed and published in the District according to law.
