Contract - Orange County - 1987-03-10 Agreement No D86-285 A G R E E M E N T 1 THIS AGREEMENT entered into this /OU` day of /fl44c$ 1987 2 by and between 3 COSTA MESA SANITARY DISTRICT hereinafter referred to as OWNER 4 AND 5 COUNTY OF ORANGE 6 hereinafter referred to as COUNTY 7 R E C I T A L S 8 WHEREAS COUNTY is preparing to contract for 'Resurfacing of Various Streets 9 in Orange County 1986 87 (Contract No 2) hereinafter referred to as PROJECT which 10 consists primarily of resurfacing or reconstructing existing streets some of which 11 lie within OWNER s service area and 12 WHEREAS OWNER maintains a sewer system, including manholes within the area 13 of COUNTY s PROJECT and PROJECT will require manhole adjustment to the new street 14 grade and 15 WHEREAS OWNER desires COUNTY to perform the adjustment of approximately 8 manholes 16 (at an estimated cost of $220 each) as part of COUNTY s PROJECT and 17 WHEREAS COUNTY is willing to include this manhole adjustment in its PROJECT 18 at OWNER s cost 19 NOW THEREFORE the parties hereto agree as follows 20 1 OWNER shall deposit with COUNTY s Environmental Management Agency $1 760 21 as the estimated cost for said manhole adjustment Said deposit shall be made within 22 30 days of receipt of this executed agreement 23 2 OWNER, prior to commencement of said PROJECT shall place a paint mark on 24 the curb opposite each manhole and indicate distance from curb face to center of 25 manhole to facilitate subsequent locating and adjusting manholes by COUNTY COUNTY 26 shall not be held accountable for failure to adjust manholes which are not marked 27 /// 28 /// 1 3 COUNTY shall include in PROJECT contract documents Adjust Manhole as 2 a bid item and through its contractor shall adjust said sewer manholes to grade 3 in accordance with PROJECT contract documents based upon the Standard Specifica- ilys JAW 4 tions for Public Works Construction t9-8-2. edition 5 4 OWNER shall pay the total cost for adjusting said sewer manholes to grade 6 Said total cost will be determined by multiplying the unit price by the total number 7 of manholes adjusted plus 10% for COUNTY inspection and administration HOWEVER, 8 to protect OWNER and COUNTY from unbalanced bids regardless of the bid amount OWNER 9 shall be responsible for a unit price not to exceed $200 but not less than $155 10 If extra work is required its cost will be added to said total cost but extra work 11 will only be performed after prior approval by OWNER s engineer or manager 12 5 COUNTY shall upon completion of said PROJECT prepare and submit to OWNER 13 a statement of the final cost authorized by this agreement which statement will 14 include total number of manholes adjusted unit price 10% inspection and administra 15 tion amount and extra work if any 16 If this final cost exceeds the deposit OWNER shall within 30 days of receipt 17 of statement pay COUNTY the difference if the final cost is less than the deposit 18 COUNTY shall with the statement refund the difference to OWNER. 19 /// 20 /// 21 /// 22 /// 23 /// 24 /// 25 /// 26 /// 27 /// 28 /// 2- 1 IN WITNESS WHEREOF the parties hereto have caused this Agreement to be executed 2 by their officers thereunto duly authorized on the date first written above 3 APPROVED COSTA MESA SANITARY DISTRICT AS TO DORM. 4 5 (' Q l,LC� Atto ev .. listrict B President 6 7 COUNTY OF ORANGE 8 9 By 0u ' amedte1/4._ Ch man of its Board of Supervisors 10 SIGNED AND CERTIFIED THAT A COPY OF THIS DOCUMENT HAS BEEN DELIVERED 11 TO THE CHAIRMAN OF THE BOARD 12 13 _ )9 G7r Linda D Robe is MAR 1 D 1987 14 Clerk of the Board of Supervisors of Orange County California 15 16 APPROVED AS TO FORM.
