UTILITY AGREEMENT NO 12069 DATE/'-it /2,470
State of California acting by and through the Department of Trans-
portation hereinafter called State proposes to construct the Costa Mesa
Freeway (Route 55) between 19th Street & Wilson Avenue and the Costa
Mesa Sanitary District hereinafter called OWNER owns and maintains
sanitary sewer siphon mains in 21st Street crossing new freeway right
of way within the limits of State s project which require relocation to
accommodate State s project
It is hereby mutually agreed that
I WORK TO BE DONE
A In accordance with Notice No 12069 dated May 17 , 1990 State
shall relocate Owner s Sanitary Sewer Siphon Main with a Pumphouse
and a 15 Pressure Sewer Line work to be performed by State s
Contractor under Change Order No 12 for the improvement of Road
Route 55 which by this reference are made a part hereof
B The Owner shall perform all work necessary for assisting State s
Contractor in the removal of existing facilities preparation of
plans engineering and billing with its own forces Owner shall
have the right to inspect the work by State s Contractor during
construction Upon completion of the relocation Owner agrees to
accept ownership and maintenance of the relocated facilities and
relinquishes to State the ownership of the replaced facility Minor
deviations from said plans may be made and incidental work may be
performed by the Owner or the State when mutually acceptable to both
parties and on approval by the State
II LIABILITY FOR WORK
The existing facilities are lawfully maintained in their present
location and qualify for relocation at State expense under the
provisions of Section 703 of the Streets and Highways Code
Utility Agreement No 12069
III PERFORMANCE OF WORK
It is understood and agreed between the parties that the State will
cause the relocation of Owner s facilities as provided in I-A above by
the State Contractor and furnish or cause to be furnished all necessary
labor material tools and equipment required therefor
It is further understood and agreed between the parties that the Owner
shall have access to all phases of the work involving Owner s
facilities being performed by the State s Contractor for the purpose
of inspection as provided in I-B above however all questions regarding
the work being performed shall be directed to the State s Resident
Engineer for his evaluation and final disposition
IV PAYMENTS FOR WORK
The State shall pay its share of the actual cost of the herein-described
work under I-A above within 90 days after receipt of Owner s itemized
bill in quintuplicate signed by a responsible official of Owner s
organization compiled on the basis of the actual cost and expense The
Owner shall maintain records of the actual costs incurred and charged
or allocated to the project in accordance with recognized accounting
principles
It is understood and agreed that the State will not pay for any
betterment or increase in capacity of Owner s facilities in the new
location and Owner shall give credit to the State for the salvage value
of materials or parts salvaged and retained or sold by Owner Accrued
depreciation credits are not applicable to this Agreement
At the election of the Owner progress bills for costs incurred may be
submitted not to exceed Owner s recorded costs as of a specific date
less estimated credit applicable to completed work when the recorded
costs are sufficient to warrant such billing The final billing shall
be in the form of an itemized statement of the total cost charged to the
project less the credits provided for in the Agreement and less any
amounts covered by progress billings
Detailed records from which the billing is compiled shall be retained
by the Owner for a period of four years from the date of the final bill
and will be available for verification by State and Federal auditors

V GENERAL CONDITIONS
All obligations of State under the terms of this Agreement are subject
to the appropriation of funds by the State Legislature and the
allocation of those funds by the California Transportation Commission
All costs accrued by Owner as a result of State s request of September
21 1987 to review study and/or prepare relocation plans and estimates
for the project associated with this Agreement may be billed pursuant
to the terms and conditions of this Agreement
If State s project which precipitated this Agreement is cancelled or
modified so as to eliminate the necessity of work by Owner State will
notify Owner in writing and State reserves the right to terminate this
agreement by amendment The amendment shall provide mutually acceptable
terms and conditions for terminating the agreement
Upon completion of the work to be done by State in accordance with the
above-mentioned plans and specifications the new facilities shall
become the property of Owner and Owner shall have the same rights in
the new location that it had in the old location

THE ESTIMATED COST TO THE STATE FOR ITS SHARE OF
THE ABOVE DESCRIBED WORK IS $ $45,000.00
IN WITNESS WHEREOF the above parties have executed this Agreement the

Gentlemen
In conjunction with the second phase of the Costa Mesa Freeway
construction, the District' s two sewer lines crossing the freeway
at 21st Street must be relocated to avoid conflict At the point
where the two existing sewers cross the freeway the new freeway
grade will be approximately 25 feet lower
It is proposed to construct a new sewer siphon under the
depressed freeway lanes to allow the sewage to continue flowing
from the east side of the freeway to the west side It does not
appear feasible to redirect the flows to another area on the east
side of the freeway due to grade conflicts plus these areas are
already flowing at capacity
Discussions are underway with CALTRANS to determine whether
CALTRANS will pay for the design, construction and inspection as
they did on the Mesa Drive force main crossing, Project 1112100-

Therefore, it is proposed to complete the design phase at the
following hourly rates, not to exceed $12,000
Engineer $ 50 00/hr
Draftsman 40 00/hr
3 man Survey Crew 155 00/hr
2 man Survey Crew 135 00/hr

Gentlemen
At a meeting on April 6 three representatives from CALTRANS
requested the Sanitary District consider other options than the
proposed sewer siphon design previously provided to them
CALTRANS requested the District investigate installing a new
pumping station and pumping across the freeway This would
entail 550 feet of new gravity sewer along Newport Blvd
Northbound from 21st Street to Bay Street a new pumping station
at Bay Street a new force main in the new bridge and 550 feet
of new gravity sewer along Newport Blvd Southbound CALTRANS
made the request since their prime contractor claims they are
unable to construct the siphon
CALTRANS also requested the Sanitary District assist them in
designing a temporary system to facilitate the freeway
construction without causing delays or interferences
Upon preliminary design of the above CALTRANS requested an
additional meeting to determine which permanent design will be
used
Therefore it is proposed to complete the design phase at the
following hourly rates not to exceed $15 000
Engineer $ 50 00/hr
Draftsman 40 00/hr
3 man Survey Crew 155 00/hr
2 man Survey Crew 135 00/hr
Please note that billing will be only for actual time worked'
CALTRANS will' be reimbursing the Sanitary District for ,the
previous design this design and inspection services provided by
the District CALTRANS will also be 'paying for the const"ruction
which will be done by their contractor The above additional

Gentlemen
The construction of the District' s new pumping station at 21st
Street and Newport Blvd by CALTRANS is about to begin and
CALTRANS has requested the Sanitary District field stake the
location of the new structure and lines
Therefore it is requested that an additional appropriation and
budget adjustment be made to cover the staking It is proposed
to do the work at the following hourly rates not to exceed the
totals shown below
Surveying (2 man crew) 8 hrs @ $140 00/hr = $1 120 00
Surveying (3 man crew) 8 hrs @ $160 00/hr = $1 280 00
TOTAL = $2,400 00
Billing will be only for actual time worked
It should also be noted that CALTRANS will be reimbursing the
District for these costs just as they are for the remaining
design and inspection costs In addition the construction is
being paid for directly by CALTRANS at no cost to the District
