Minutes - Board - 1958-08-21MINUTES OF THE REGULAR ADJOURNED MEETING BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT HELD AT 695 W. 19TH STREET r ` August 21, 19;8 Roll Call Present: Directors Nelson, Norman, Hollister and Meyers. Absent: Director Porter. Officials Present: Assistant Secretary Swartz, Finance Director Hartzler, Engineer Southworth, Attorney Dungan, Street Foreman Heller. The meeting was called to order at 7 :30 P.M. by President Meyers. Public Hearing.- The Secretary notified the Sanitary Board that this was the time and Annexation #46 place fixed for the hearing on the petition presented to this Board C gney for the annexation of the property owned.by Mr. James Cagney, adjacent to Hoag Hospital and more particularly described as a portion of Block 2, Lot 169, and a portion of Block 1, Lot 172, Irvine Sub- division. The President then announced that this was the time and place set for the hearing of protests. The President then inquired of the Secretary whether aty written objections to the annexation had been filed with him prior to the time set for hearing. The Secretary reported that he had not received any written objec- tions against the proposed annexation and /or the inclusion of any property within such annexation territory. The Assistant Secretary f, had not received any written objections in his office. There being no protests or objections from the floor it was moved by Director Nelson and seconded b�, Norman and unanimously carried that the hearing be closed. resolution #23A Whereupon on motion.of Director Hollister, seconded by Director Annexation #46 Nelson, Resolution No. 23A to ANNEX CERTAIN TERRITORY TO THE Ca.gney COSTA MESA SANITARY DISTRICT OF ORANGE COUNTY, CALIFORNIA, was adopted by the following roll call vote: AYES: Directors Nelson, Norman, Hollister and Meyers. NOES: Directors - None. ABSENT: Director Porter. C':r°al Communi- Mr. August Schwecheimer restated his complaint regarding the height cc.ons of the sewer lateral in front of his property on Wallace Avenue. The Attorney informed the Board that the District did not have any legal liability concerning this complaint, that all notices regarding the construction and installation of sewer mains and service con- nections were duly made as required by l3.w. After considerable consideration, and after finding that Mr`: Schwecheimer did not receive actual notice of the proposed improve - ment, Director Nelson moved that the District pay Mr. Schwecheimer • I $65.00 in full settlement of all claims. It was seconded by Director - 2 - Norman and carried unanimously by the following roll call vote: AYES: Directors Nelson, Norman, Hollister and Meyers. NOES: Directors - None. ABSENT: Director Porter. Easements - Engineer Southworth stated that the Irvine,Company would grant to Annexation #19 the District certain easements across their property if they knew what Irvine Co. charges.they would have to pay for the use of'the sewer main in the event -that at a later date they desired to annex their property to this District and use this main. On motion by Director Hollister, seconded by Director Norman, and, unanimously carried, an Agreement with the Irvine Company regarding sewer easement on Irvine property in connection with Annexation No. 19 was approved, and the President and Secretary authorized to sign said Agreement, which Agreement contained the following: (a) That in consideration for the Irvine Company granting an easement over its properti s, all as shown on the plans and specifications of:Plan #,5for the installation of sanitary sewers in Annexation No. 19, District agrees as follows: (1) To annex the properties fronting on said easement to the Costa Mesa Sanitary District upon applica- tion, and the payment of the established annexation fee, by the Irvine Company. (2) After annexation of the property fronting said ease- ment, to allow the Irvine Company to make connections to said sewer line in the easement, upon the pay- ment to District of a sum equal to the front foot charge paid by the owners of adjacent property under Assessment No. 6, for the installation of Sanitary Sewers under the "1911 Improvement District Act" for annexation No. 19. Les„lution #70 Director Nelson moved the adoption of Resolution #70, "A RESOLUTION ,at-on #19- OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT OF Isenacnts ORANGE COUNTY, FINDING, DETERMINING AND DECLARING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN EASE- MENTS AND RIGHTS -OF -WAY FOR SANITARY SEWER PURPOSES AND AUTHORIZING THE ACQUISITION OF SAID EASEMENTS AND RIGHTS -OF -WAY BY CONDEMNATION AND DIRECTING THE ATTORNEY FOR SAID DISTRICT TO PROCEED WITH SUCH ACTION." The motion was, seconded by Director Hollister and carried by the following roll call vote: AYES: Directors Nelson, Norman, Hollister and Meyers. NOES: Directors - None. ABSENT: Director Porter. Aftiaute Resolution It was moved by Director Hollister, seconded by Director Nelson NEPW and unanimously carried that the Director of Finance be authorized to prepare warrants for payment of the acquisition of the ease- ments pursuant to Resolution No. 70. Trash & Garbage The Attorney stated that the Santa Ana Commercial Company, Inc. Contract was not in accord with counting trailer parks as one unit of occupancy as stated in the new contract. As no one was present from the Santa Ana Commercial Company, Inc., it was agreed that this matter be taken up at the next regular meeting to be held September 4, 1958 at 7:30 P.M. War-rant No's. Upon motion of Director Nelson, seconded by Director Norman, 1818 & 1819 Warrant No. 1818, acquisition of easement and right of way by condemnation per Resolution No. 65, and Warrant No. 1819 for postage for election ballots, was ordered paid by the following roll call vote:. AYES: Directors Nelson, Norman, Hollister and Meyers. NOES: Directors - None. ABSENT: Director Porter. Rea uest for Street Foreman Heller stated that several property owners on the Permission to northerly side of Mesa Drive have requested connections to existing ' ANRL9nnect to Sewer sewer. It was,moved by Director Nelson and seconded by Director Hollister and unanimously carried that residents on the northerly side of Mesa Drive could be connected to the sewer by putting up a minimum deposit of $150.00. From this deposit there will be deducted a service charge of $50.00 per year or fraction thereof until such time as the area has constructed its own sewers.
