Subject: Concept Approval / Benefits Summary Update
BACKGROUND: This memo updates the summary of the activities, documents and benefits staff
prepared to assist the CMSD transition to its new facility and operations independent of the City of
Costa Mesa. Staff followed Board authorizations to provide District personnel with at least the
coverages and benefits the City of Costa Mesa currently provides to existing employees.
(Reference Costa Mesa City Employees Association and the City of Costa Mesa Memorandum of
Understanding, 2001 - 2003). The Discussion section updates main topics and addresses the areas
District Counsel itemized in a January 26, 2004 letter to Staff.
DISCUSSION:
1. District Employment: Existing Employees are categorized as "Vested ", New
Employees are categorized as "At Will" and serve at the pleasure of the District (not
vested);
2. CMSD Organization Chart: Completed October 2003; Incorporates all existing and
new staff CalPERS positions as follows:
a. Assistant Manager
b. Board Secretary/Program Manager
c. Permit Processing Specialist
d. Permit Processing Specialist
e. Accountant
f. Office Specialist
g. Ordinance Enforcement Officer
3. CMSD Employee Descriptions: Completed September 2003; Staff positions reflect
actual descriptions of current responsibilities; Field crew positions reflect updates to
existing City of Costa Mesa job descriptions; California Water Environment (CWEA)
Certification requirements' incorporated as appropriate; Awards 1.5% /Certification
level earned;
4. CMSD Employee Salary Structure: Structure based on 7 steps as City of Costa
Mesa currently uses; 5% increase per step; Incorporates results from surveys of
local districts, City of Costa Mesa Schedule, and the 2003 -04 Special District
Administrative Salary and Benefits Survey compiled by the California Special
District Association, and Industry Insights, Inc.;
5. CaIPERS Application — Submitted 12 -23 -2003; Final Resolution approval: 6- 16 -04;
Incorporates same basic and optional benefits as the City of Costa Mesa;
a. Pension Benefit Contribution: Same as the City of Costa Mesa; District
pays both employee (7 %) and employer (currently 13.881 %, but varies each
year depending on investments and economy) contributions to CaIPERS;
b. Benefit Formula: 2% @ 55;
c. Medical Insurance: In process; same offerings as the City of Costa Mesa
where possible (District size may affect rates);
d. Dental Insurance: In process; same offerings as the City of Costa Mesa
where possible;
e. Life Insurance: In process; same offerings as the City of Costa Mesa where
possible;
"Benefits Bucket ": Same as the City of Costa Mesa; Each employee
receives the same "bucket' of funds to select and pay for desired benefits
and levels of coverage — unused "bucket" funds are paid directly to the
employee as additional compensation; monthly "bucket" is $619 or
$285.69/pay period for 26 pay periods (2004 is a unique year with 27 pay
periods equaling $275.11/pay period for 27 pay periods);
g. Other: Cost of Living Allowance Universally applied to CalPERS
employees, based on US Department of Labor May -to -May Consumer Price
Index for All Urban Consumers for Los Angeles, Riverside and Orange
County (CPI -U), implemented at the start of the upcoming fiscal year (July
1). Upon a CalPERS employee reaching the top step in his /her pay step
category, the pay also shall be increased at 2% per year for three years.
During the third year the manager will re- evaluate the salary structure.
6. Relocation /Real Estate Acquisition: Ongoing — 628 W 19`h St; Closed Escrow
June 4, 2004;

9. Vacation Accrual Rate: Same as the City of Costa Mesa; 92 hrs for up to three

a starting rate based on number of years of City service;
a. Sick Leave: Same as the City of Costa Mesa; 96 hrs earned /year;
b. Holidays: 12 paid holidays per year including 2 paid Floating Holidays;
Same as the City of Costa Mesa;
c. Employee Assistance Program: Employee Support Systems Company
(ESSCO); $2 /month /employee; 34 page proposal and 5 page contract
received 2- 19 -04; Effective July 1, 2004;
10. Treasurer and Accountant Agreements: Nearing completion 6- 15 -04;
SUMMARY AND CONCLUSION: Staff recommends the District Board approve the stated
concepts and described benefits and direct Staff to continue to pursue remaining topics.

CONTRACT

and the
Board of Directors
Costa Mesa Sanitary District
In consideration of the covenants and agreement hereafter contained and on the part of
both parties to be kept and performed, the governing body of above public agency,
hereafter referred to as "Public Agency ", and ,the Board of Administration, Public
Employees' Retirement System, hereafter referred to as "Board" hereby agree as
follows:
1. All words and terms used herein which are defined, in the Public
Employees' Retirement Law shall have the meaning as defined therein
unless otherwise specifically provided. "Normal retirement age" shall
mean age 55 for local miscellaneous members.
2. Public Agency shall participate in the Public Employees' Retirement
System from and after July 1, 2004 making its
employees as hereinafter provided, members of said System subject to all
provisions of the Public Employees' Retirement Law except such as apply
only on election of a contracting agency and are not provided for herein
and to all amendments to said Law hereafter enacted except those, which
by express provisions thereof, apply only on the election of a contracting
agency.
3. Employees of Public Agency in the following classes shall become
members of said Retirement System except such in each such class as
are excluded by law or this agreement:
a. Employees other than local safety members (herein referred to as
local miscellaneous members).
4. Any exclusion(s) shall remain in effect until such time as the Public
Employees' Retirement System determines that continuing said
exclusion(s) would risk a finding of non - compliance with any federal tax
laws or regulations. If such a determination is contemplated, the Public
Employees' Retirement System will meet with the Public Agency to
discuss the matter and coordinate any required changes or amendments
to the contract.
In addition to the classes of employees excluded from membership by
said Retirement Law, the following classes of employees shall not become
members of said Retirement System:
a. SAFETY EMPLOYEES.
5. The percentage of final compensation to be provided for each year of
credited prior and current service as a local miscellaneous member shall
be determined in accordance with Section 21354 of said Retirement Law
(2% at age 55 Full).
6. Public Agency elects to be subject to the following optional provisions:
a. Section 20042 (One -Year Final Compensation).
b. Section 20965 (Credit for Unused Sick Leave).
C. Section 20903 (Two Years Additional Service Credit).
d. Section 21023.5 (Public Service Credit for Peace Corps,
AmeriCorps VISTA, or AmeriCorps Service).
e. Section 21024 (Military Service Credit as Public Service), Statutes
of 1976.
f. Sections 21624 and 21626 (Post- Retirement Survivor Allowance).
7. Public Agency shall contribute to said Retirement System the contributions
determined by actuarial valuations of prior and future service liability with
respect to local miscellaneous members of said Retirement System.
8. Public Agency shall also contribute to said Retirement System as follows:
a. Contributions required per covered member on account of the 1959
Survivor Benefits provided under Section 21574 of said Retirement
Law. (Subject to annual change.) In addition, all assets and
liabilities of Public Agency and its employees shall be pooled in a
single account, based on term insurance rates, for survivors of all
local miscellaneous members.
b. A reasonable amount, as fixed by the Board, payable in one
installment within 60 days of date of contract to cover the costs of
administering said System as it affects the employees of Public
Agency, not including the costs of special valuations or of the
periodic investigation and valuations required by law.
C. A reasonable amount, as fixed by the Board, payable in one
installment as the occasions arise, to cover the costs of special
valuations on account of employees of Public Agency, and costs of
the periodic investigation and valuations required by law.
9. Contributions required of Public Agency and its employees shall be
subject to adjustment by Board on account of amendments to the Public
Employees' Retirement Law, and on account of the experience under the
Retirement System as determined by the periodic investigation and
valuation required by said Retirement Law.
10. Contributions required of Public Agency and its employees shall be paid
by Public Agency to the Retirement System within fifteen days after the
end of the period to which said contributions refer or as may be prescribed
by Board regulation. If more or less than the correct amount of
contributions is paid for any period, proper adjustment shall be made in
connection with subsequent remittances. Adjustments on account of
errors in contributions required of any employee may be made by direct
payments between the employee and the Board.

WHEREAS, the Public Employees' Retirement Law provides for the participation of a
Public Agency in the California Public Employees' Retirement System,
making its employees members of said System; and
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District on
May 10 , 2004 , adopted a Resolution giving
notice of intention to approve a contract providing for such participation; and
WHEREAS, the employees of said public agency, whose memberships in said
Retirement System are contemplated, have approved said participation, by
majority vote;
NOW, THEREFORE, BE IT RESOLVED, that a contract between the Board of
Directors of the Costa Mesa Sanitary District and the Board of
Administration, California Public Employees' Retirement System is hereby
authorized, a copy of said contract being attached hereto and by such
reference made a part hereof as though herein set out in full; and
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the presiding officer of said

Note: The District pays the full -time employee's contribution to the Public Employees' Retirement System (PERS) 2% at
55. The District does not participate in the Social Security system; however, federal mandate requires new employees to
contribute 1.45% of wages to Medicare. After qualifying, the District compensates 2.5% or 5% above base monthly
salary for bilingual pay. As a condition of employment, all new employees are required to enroll and participate in the
direct deposit program; also, the District contributes 1% of base monthly salary to the employee's retiree medical
account, with a regular matching 1% of base salary contribution by the employee.
The Accountant performs a wide variety of responsible and professional accounting tasks and other related work as required.
Essential Functions Include:
- Prepares and maintains complex financial statements and statistical reports for the District;
- Maintains automated District general and subsidiary ledgers and journals;
- Conducts and prepares cost studies, internal audits and analytical reviews of data using financial, cost and
managerial accounting principles; Audits tax reports, records of permits for sewerage fees;
- Prepares and processes the District payroll; maintains payroll records and reports;
- Prepares complex internal and external automated financial reports;
- Prepares monthly warrant list; Codes documents for proper account classifications;
- Prepares and processes purchase orders, invoices, payroll time cards, asset inventory reports, monthly bank
reconciliations and bank deposits;
- Maintains control of the fixed assets accounting system;
- Assists in budget research, analysis and forecasting; Prepares and analyzes budgets to actuals;
- Performs related work as required;
Qualifications Guidelines:
- Graduation from a four year college or university with major course work in accounting, business
administration, or other related field;
- Considerable professional accounting experience, preferably -with a special district/government agency;
- Experience using client -server financial management systems and accounting software for personal
computers is highly desirable;
- Thorough knowledge of governmental accounting, budgeting and auditing practices, standards and
principles; and office practices and procedures as applied to financial operations. Ability to work effectively
in a customer service environment with a team approach. Skill in using MS Office (Word, Excel,
PowerPoint, Outlook);
Ability to communicate effectively orally and in writing; establish and maintain effective and cooperative
working relationships;
Physical Tasks and Environmental Conditions: Ability to sit, reach, twist, turn, lean, reach to access supplies and use
equipment; operate a computer keyboard, typewriter, calculator lift files and reports from desktops or file drawers. Exposure
to vibration, pitch and glare from a computer.

Application Materials and two self-addressed envelopes must be submitted before the closing date. Attaching a resume is encouraged, but
resumes are not accepted in lieu of an official application form.
An Eligibility List containing the names of the most qualified applicants will be compiled based on the results of the selection process. The list will
normally remain in effect for one year unless exhausted earlier or the District extends the list.
A Medical Examination, conducted by a District designated physician, must be satisfactorily completed prior to appointment for designated positions.
A Non - smoking Policy: smoking is prohibited in District facilities.
Vacation Leave is accrued at the equivalent of 11 1/2 eight -hour workdays per year, with additional workdays added after three, five, ten, and fifteen years
of service (up to a maximum of 23 1/2 eight-hour workdays per year).
Sick Leave is accrued at the rate of eight hours per month to a maximum of 60 eight -hour workdays. All positions earn special pay (or additional vacation)
at the rate of one -half for sick leave credits after the maximum is reached.
Holidays are provided for all District employees either as time off or additional compensation. The District observes 12 holidays per year.
Group Benefit Programs, including Life, Medical, Disability and Dental coverage are available. The District pays the major portion for the
employee's and dependents' coverages through a cafeteria plan of flexible benefits.
Retirement Program: All full -time employees have compulsory membership in the California Public Employee's Retirement System (CaIPERS) which
provides retirement benefits based upon the formula of "2% at age 55 ". The District does not participate in the Social Security System for full -time employees;
however, federal mandate requires new employees to contribute 1.45% of wages to Medicare.
Overtime Compensation for work beyond the scheduled work shift or workweek is at either time -and- one -half or compensatory time off.
A Deferred Compensation Program enabling employees to "save" salary and earn interest on a tax - deferred basis is available.
A Certification Program provides additional monetary awards for earning certification levels in the California Water Environment Association. The
District compensates 11/2 percent additional monthly compensation for each of four levels of certification earned in "Collection Systems Maintenance".
Reimbursement for Tuition and Books for approved college courses is provided at up to $500 per semester.
Credit Union membership for checking, savings and loan privileges is available to all District employees and their immediate family members.
EMPLOYMENT INFORMATION FOR PART -TIME EMPLOYEES
Part -time Employees are at -will and serve at the pleasure of the District. They are reviewed for merit salary advancement on a periodic basis. Generally,
part- timers are limited to no more than 1000 hours of work per fiscal year. Certain part -time employees, however, are permitted to exceed this limit. Part -time
employees participate in either CAPERS or the California Public Agency Retirement System (CalPARS). The employee contribution equals 7% (CaIPERS) or
3.75 %(CalPARS) of salary, respectively which the District matches.
General Leave. Certain part -time positions are eligible to receive general leave benefits. This can be used for sick, vacation, or holiday time. However,
part-time employees must have continuously worked for at least 520 hours before earning general leave.
