AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE
COSTA MESA SANITARY DISTRICT CHANGING THE
MEETING DATE OF THE REGULAR BOARD MEETING
WHEREAS, Government Code § 54954 provides that the Board may
establish by ordinance the time for holding regular meetings; and
WHEREAS, Health and Safety Code § 6488 provides that the Board shall
hold its meetings in the day or evening as may be convenient; and
WHEREAS, the Board had previously established the second Thursday of
the month at 6:00 p.m. as the date and time for its regular meetings; and
WHEREAS, the Board does hereby determine that it would be more
efficient for District business to be conducted on the fourth Thursday of the
month at 5:30 p.m. so that reports and month -end closeout items can be finalized
before the agenda is prepared;
NOW, THEREFORE, the Board of Directors do hereby ORDAIN as
follows:
Section 1. That Section 3.01.060 of the Costa Mesa Sanitary District Operations
Code is hereby amended to read:
"3.01.060. Time of Regular Meetings. The Board of Directors shall hold
its regular meetings on the fourth Thursday of the month at 5:30 p.m. unless
notification is otherwise given. The Board shall endeavor to conduct its business
on its regular meeting date and if a meeting must be rescheduled, shall endeavor
to schedule any specially set meetings to a later date. Nothing herein stated is
meant to preclude the District from scheduling a meeting at an earlier date and /or
time, provided notice has duly been given, when the same is determined to be in
the District's best interests. Any person having business before the Board
showing an acceptable excuse for not being present due to changed date, time
or place of a meeting may request the Board to reschedule the item for a
subsequent meeting."
Section 2. Should any part, clause or section of this Ordinance be declared by any
Court of competent jurisdiction to be invalid, the remaining provisions of this
Ordinance shall nevertheless be and remain in full force and effect and the Board of
Directors of the Costa Mesa Sanitary District of Orange County, California, hereby
declares that each and every section, clause, provision or part of this Ordinance
would have been adopted and made a part of this Ordinance without the adoption
of any portion thereof and that the invalidity of any part or provision hereof shall not
in any way affect the validity or enforcement of the remaining provisions of this
Ordinance that may stand on their own.
Section 3. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the
Clerk shall cause this ordinance or a summary thereof to be published in a
newspaper of general circulation printed and published in the District according to
law.
