AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY
DISTRICT OF ORANGE COUNTY, CALIFORNIA, AMENDING ORDINANCE NO. 6
RELATING TO PERMITS AND PERMITS FOR SURCHARGES FOR EXCESS SEWAGE
FLOW, INCREASING SAID CHARGES AND MAKING PROVISION THEREFOR.
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT OF ORANGE
COUNTY, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The Board of Directors of the .Costa Mesa Sanitary District
of Orange County, California finds and declares that surcharges for the use
of the facilities of the District exceeding fifteen thousand (15,000) cubic
feet per acre per month, said charges having been established in 1969, are
no longer adequate to provide for repair, maintenance, upkeep, and replacement
of facilities necessitated by said excessive use. The Board further finds and
declares that any reference to a classification of properties by reason of the
ad valorem tax is no longer a valid method of classifying properties insofar
as surcharges are concerned. The Board further finds and declares that in-
creases in the Consumer Price Index from 1969 to 1984 are one of the criterion
used in determining the inadequacy of surcharges. the boara rurtiner I111u." Qllu
declares that substantial costs in sewage facility construction have occurred
since 1969 when original surcharges were established necessitating an increase
in said charges. The Board further finds and declares that the health,
safety and welfare of the community will not be adequately served unless said
surcharges are increased.
Accordingly, Ordinance No. 6 of the Costa Mesa Sanitary District is
hereby amended to read as follows:
SECTION 2. "ARTICLE 2 — PERMIT REGULATIONS
(c)
(3) Surcharges for Use Permit. The District hereby establishes
the quantity of 15,000 cubic feet of sewage or industrial waste per month per
acre of real property served as the maximum allowable effluent to be dis-
charged into the District's sewerage facilities without the payment of sur-
charges. Each user discharging more than 15,000 cubic feet of sewage or
industrial waste per month per acre shall be charged $3.00 per 1,000 cubic

feet or any portion thereof in excess of the 15,000 cubic feet maximum. All
public agencies shall be exempt from payment of any surcharge herein estab-
lished. Measurements may be required by the permittee, or permittee's efflu-
ent may be considered equivalent to the water (excepting irrigation water)
purchased by the permittee. Permittee upon demand shall provide District
with his or its water usage records and District shall bill excess users of
the system monthly based upon the charges set forth herein."
SECTION 3. The Secretary of the District shall certify to the passage
of this Ordinance and shall cause the same to be published once in the Orange
Coast Daily Pilot, a newspaper of general circulation published daily within
the Costa Mesa Sanitary District of Orange County, California, and seven days
after its publication, it shall be in full force and effect.
