A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA
SANITARY DISTRICT MAKING FINDINGS REGARDING THE USE OF
REDEVELOPMENT MONEY FOR A PUBLIC PROJECT
WHEREAS, Health and Safety Code Section 33445 provides that before a
redevelopment agency can spend redevelopment money on a public project, certain
findings must be made; and
WHEREAS, the Costa Mesa Sanitary District has been negotiating with the
Orange County Development Agency and the City of Newport Beach to provide new
sewer service to an area that has inadequate sewer service at the present time; and
WHEREAS, as part of that process, the Board must make findings before an
agency may pay for the cost of a public improvement; and
WHEREAS, Health & Safety Code Sections 33030 and 33031 recognize that
inadequate utilities can be a blighting condition;
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District
does hereby RESOLVE to make the following findings:
1. That the improvement will be of benefit to the project area: The sewer line
will directly serve that area or the immediate neighborhood.
2. That no other means of financing the improvements exist: The District is
committing its funds to keeping the existing system in good order to comply with the
State Water Resources Board's waste discharge order. All money has been committed
pursuant to a capital improvement plan.
3. That the expenditure of this money will eliminate blighting conditions as
follows: inadequate utilities are within the legislative definition of blight. (Health & Safety
Code §§ 33030, 33031.)
4. That District is advised that such project is in the Orange County
Development Agency's existing development plan.
