A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
COSTA MESA SANITARY DISTRICT
APPROVING AN ALTERNATIVE FORMULA FOR DISTRIBUTING LAFCO FEES
AMONG THE INDEPENDENT SPECIAL DISTRICTS IN ORANGE COUNTY
WHEREAS, Government Code Section 56381 requires the Orange County Local
Agency Formation Commission ( LAFCO) to annually adopt a final budget for LAFCO
operations by June 15th; and
WHEREAS, on May 11, 2005, LAFCO discussed, considered and adopted the
final LAFCO budget for fiscal years 2005 -2006, 2006 -2007 and 2007 -2008 during a
noticed public hearing as required by law; and
WHEREAS, Government Code Section 56381 requires that the Commission's
annual operating costs be equally divided between the County, cities and independent
special districts; and
WHEREAS, Government Code Section 56381(c) requires that the independent
special districts' share be allocated to each district using each district's total revenues
as a percentage of the combined total district revenues within a county; and
WHEREAS, Government Code Section 56381(d) allows for an alternative
allocation method if approved by a majority of the districts, representing a majority of
their combined populations; and
WHEREAS, on April 17, 2001, the Independent Special Districts of Orange
County ( ISDOC) adopted an alternative formula for distributing the special districts'
share of LAFCO's budget; and
WHEREAS, the alternative formula recognized the need for all special districts to
contribute, that no one district should bear a disproportionate share of the cost, and the
differences in the ability to pay between enterprise and non - enterprise districts; and
WHEREAS, on July 1, 2005, two additional independent special districts, the
Orange County Vector Control and the Orange County Cemetery District, were formally
added by ISDOC as subject to the LAFCO budget apportionments under Government
Code Section 56381.
BE IT RESOLVED, that the Costa Mesa Sanitary District reaffirms its vote of
April 17, 2001 to use the alternative formula developed by the Independent Special
Districts of Orange County and adopted on that date as the continuing formula for
assessing the independent special district shares of the LAFCO operating budget.
