Subject: Receive and File February 2023 Code Enforcement Officer Report
Summary
This report summarizes major points for three ordinance enforcement topics covering scavenging, graffiti on trash carts,
and trash container enforcement. For the month of February, 2023, the CMSD Interim Code Enforcement Officer (CEO)
focused his efforts on patrols in various parts of the community. The goal is to identify and deter instances of scavenging
and residential trash carts left within the public view.
Recommendation
That the Board of Directors receives and files this report.
Analysis
In the month of February, the District saw several complaints filed with CMSD Interim Code Enforcement staff regarding
scavenging activity in the city. As with most scavenging complaints, the alleged violations take place in the early morning
hours. To address resident concerns, the Interim Code Enforcement Officer is patrolling streets by 6:30 am.
Legal Review
Not applicable.
Environmental Review
Code enforcement activities and reporting are not a disturbance of the environment similar to grading or construction and
do not constitute a project under CEQA or the District’s CEQA Guidelines.
Financial Review
Officer Griffins' activities are funded in the adopted budget.

Subject: California Air Resource Board Proposed Advanced Clean Fleet Regulation - Medium and Heavy Duty
Zero Emission Fleet
Summary
The Advanced Clean Fleets rule is a purchase requirement for medium and heavy-duty fleets to adopt an increasing
percentage of zero-emission trucks. It will complement the previously adopted Advanced Clean Trucks regulation requiring
manufacturers to sell ZEV trucks. Together the two regulations are the means of achieving Governor Newsom’s executive
order requiring 100% of heavy-duty truck fleets in the state to be zero-emission, wherever feasible, by 2045.

Analysis
According to CARB heavy-duty trucks currently account for 26% of all smog-forming nitrogen oxide emissions in California
and about a third of mobile diesel fine particulate matter emissions. The proposed rule consist of three different purchase
requirements for fleet operations, which are:
1. Private fleets with 50 or more trucks
2. Drayage trucks operating form seaports or railyards; and
3. State and local government fleets.
Attached is a presentation about CARB Advanced Clean Fleet regulations that was presented to ISDOC (Independent
Special Districts of Orange County) general managers on February 14, 2023. Between 2024 to 2026, state and local fleets
must purchase 50% of their fleet with zero emission vehicles (ZEV) or Near-zero-emissions vehicles (NZEV). NZEVs are
defined as hybrid electric vehicles with externally rechargeable energy storage system that allow for an all-electric range.
The Districts Ford Maverick pickup truck used by the Engineering Department is a NZEV vehicle. By January 1, 2027, all
purchases must be ZEV or NZEV.
The proposed regulations does allow for extensions and exemptions. For instance, state and local government agencies
can continue using existing internal combustion engine (ICE) vehicles until replacement ZEV is received. In addition,
agencies are allowed to purchase ICE vehicles if ZEV in needed configuration is not available. The exemption rule would
apply to replacing the District's combination sewer cleaning units as manufacturers have no intentions to manufacture ZEV
combination sewer cleaning units because the purchase price would be prohibitive for most agencies. Currently, the cost
to purchase one combination sewer cleaning unit is $500,000, but manufacturers estimate the cost to purchase a ZEV unit
would be has high as $1.2 million. Furthermore, the battery pack to power vacuum part of the unit would be available for

one hour before it needs to be recharged. For the solid waste industry, the exemption rule would not apply because fully
electric refuse trucks are being manufactured and some cities such as Carson, Los Angeles and Santa Cruz have already
or will soon put ZEV refuse trucks in operations.
Costa Mesa Sanitary District Fleet
CMSD has eleven vehicles and one forklift in the fleet. The breakdown of the eleven vehicles in the fleet are as follows:
Three (3) heavy-duty, Class 8 (Gross Vehicle Weight Rate (GVWR) greater than 33,000 lbs.) combination sewer cleaning
units. These units are exempt from CARB's proposed Advanced Clean Fleet regulations.
One (1) medium-duty Class 6 GVWR greater than 19,500 lbs. and less than or equal to 26,000 lbs. utility crane truck. This
unit is scheduled for replacement before the proposed regulations go into effect. After acquiring the new unit it will be
scheduled for replacement in 2033.
Three (3) medium-duty Class 2b through 3 GVWR greater than 8,500 lbs. and less than or equal to 14,000 lbs. pickup
trucks. These units are scheduled replacement in 2030 and 2031.
Two (2) light-duty pickup trucks. These units are scheduled for replacement in 2032.
One (1) ZNEV pickup truck that is scheduled for replacement in 2032.
One (1) ZEV sedan that is scheduled for 2033
The forklift was acquired in 2022. It's scheduled for replacement in 2042.
CARB's Advanced Clean Fleet regulations will not have an immediate impact on CMSD's fleet because our fleet is young.
However, if the District acquires additional units to the fleet after 2024 then the unit(s) will have to be ZEV or NZEV.
CR&R's Refuse Trucks
CR&R has made a significant investment to converting its fleet to Renewable Natural Gas (RNG) by using anaerobic
digestion technology. CARB's Advance Clean Fleet regulations is allowing CR&R to continue acquiring RNG refuse trucks,
but if CR&R adds additional refuse trucks to its' fleet those new units must be ZEV. CR&R is going to acquire and test one
ZEV refuse truck with anticipation the unit will be in operations by 2024.

Environmental Review
The environmental analysis of CARB's proposed Advanced Clean Fleet regulations can be found in CARB's Notice of
Public Hearing (Page 17) dated October 27, 2022.
Preparing a report about proposed state regulations is an administrative matter, and administrative matters are exempt
under CEQA and the District’s CEQA Guidelines. The SSMP assists the District in providing comprehensive sewer system
management, including protection of the environment by eliminating sanitary sewer overflows.
Financial Review
Because the District's fleet is young, the District will not experience any immediate or near term fiscal impacts from the
Advanced Clean Fleet regulations.
