ITEMS OF STUDY To: Board of Directors Via: Scott Carroll, General Manager From: David Griffin, Interim Code Enforcement Officer Date: October 13, 2022 Subject: Receive and File September 2022 Code Enforcement Officer Report Summary This report summarizes major points for three ordinance enforcement topics covering scavenging, graffiti on trash carts, and trash container enforcement. For the month of September, 2022, the CMSD Interim Code Enforcement Officer focused his efforts on patrols in various parts of the community. The goal is to identify and deter instances of scavenging and residential trash carts left within the public view. Recommendation That the Board of Directors receives and files this report. Analysis In the month of September, Interim Code Enforcement Officer (CEO) Griffin approached one individual after observing them scavenging from CMSD trash carts. In the same month he issued 113 warning notices to residents storing their trash carts in public view. No cases of graffiti on trash carts were observed. Legal Review Not applicable. Environmental Review Code enforcement activities and reporting are not a disturbance of the environment similar to grading or construction and do not constitute a project under CEQA or the District’s CEQA Guidelines. Financial Review Officer Griffins' activities are funded in the adopted budget. ITEMS OF STUDY To: Board of Directors From: Scott Carroll, General Manager Date: October 13, 2022 Subject: 2022 Missed Trash Pick-Up (January - September) Summary The Board of Directors requested monthly updates regarding the progress being made to consistently reduce the number of missed trash pick-ups occurring in the community. Recommendation That the Board of Directors receive and file this report. Analysis There were a total of 812 missed trash pick-ups during the past eight months of 2022. Attached is the breakdown of the missed pick-ups by month. The data collected is from residents logging complaints in CMSD's online Citizen Request Management System (GoGov) and receiving complaints residents logged in at Costa Mesa city hall. The data represents the number of homes that did not have their trash picked up on their regularly scheduled collection day. The primary reasons for service delays are truck breakdowns and unscheduled leave from drivers; however, some missed collections were due to carts not being placed at the proper location for collection or the carts were placed on the curb after the street was serviced by CR&R. 94 of the 178 missed collections were on Republic Avenue, Grove Place and Linden Place when their carts were not emptied on September 12. September's data represents approximately 0.77% of the total single-family units (23,091) CR&R services every week. Legal Review Not applicable Environmental Review Receiving an update on missed trash collection requests is an administrative matter and is exempt from the requirements of the California Environmental Quality Act (CEQA) (Public Resources Code Section 21000 et. seq.). Section 15300.4 of CEQA allows an agency while establishing its own procedures “to list those specific activities which fall within each of the exempt classes”, and the District has adopted “CEQA Guidelines and Implementing Procedures” that state on page 6 ”Projects” does not include …. C. Continuing administrative or maintenance activities.” Financial Review There are no financial impacts to the District for creating this report. ITEMS OF STUDY To: Board of Directors From: Scott Carroll, General Manager Date: October 13, 2022 Subject: Discuss and Provide Feedback to Agreed Upon Negotiation Bullet Points for Future Agreement with CR&R Environmental Services Summary Since February 2022, District staff and solid waste consultant, Michael Balliet Consulting (MBC) have been in negotiations with CR&R Environmental Services (CR&R) for a new SB 1383 compliant solid waste agreement. The following bullet points have been agreed upon by staff and CR&R. Recommendation That the Board of Directors discuss and provide feedback to the agreed-upon negotiation bullet points for a future agreement with CR&R Environmental Services. Analysis CR&R agrees to pay half of the cost (50/50 of $20,000) to perform a biennial community-wide citizen survey. CMSD will move from paying per tonnage rates to flat monthly fee for all services SB 1383 Outreach – CR&R will provide direct mail, cart hangers, knock & talk, and lid flipping auditing, to name a few outreach efforts. CR&R Audit Buddy App - CR&R will provide data from their smartphone app to report to CalRecycle. New carts will have an RFID code that will allow CMSD staff to track when carts were emptied. CMSD will have access to the technology that captures driver, route, and service information in real-time to assist with missed collection claims. Extra cart revenue sharing will remain 80/20 where the District receives 80% of revenues and CR&R receives 20% of revenues. CR&R will keep 100% of ancillary services revenues. CR&R and District agree to continue using the following rate comparison survey: Submit an annual review of thirty-three (33) Orange County agencies comparable Net to Hauler rates and a justification of CR&R's rates as being within ten percent (10%) of the average Net to Hauler rate (total amount CR&R is paid by District divided by the total number of units serviced) of the thirty-three (33) Orange County agencies. CMSD will continue to bill residents through County assessments. 3-Cart System - CMSD and CR&R agree that the three-cart system will include one black cart (trash), one blue cart (recyclables), and one green (organics) cart. Residents will have the option to request for a second green cart at no additional cost. The blue cart will be 90 gallons and residents will have the option to switch their 65-gallon black cart for a 90-gallon black cart. If residents have two mixed waste carts, one of the carts will be removed and replaced with a blue cart. Cart Inventory - CR&R will conduct an inventory control program to determine the number of carts at each household. CR&R is implementing user verification by mailing letters to residents and encouraging them to verify the number of carts in their possession by using an online system. Each resident will have a unique account number assigned to him/her for identity purposes and to log into the system. CR&R and CMSD will start working on the parameters for an audit/user verification program that will include having cart serial numbers assigned to households. Having cart serial numbers assigned to households will help defend CMSD/CR&R action for issuing contamination fees and/or fines. CMSD will upload the inventory data from the audit/user verification program into GIS. Liquidated Damages – CMSD and CR&R agree that CMSD can apply liquidated damages to CR&R if more than 22 missed collections per week occur. Residents placing their carts on the curb after service or the city not notifying CMSD and/or CR&R about street improvements would not apply for missed collections. Highlighted liquidated damages cited in the City of Newport Beach contract will be applied in CMSD’s contract. Subject 3. Discuss and Provide Feedback to Agreed Upon Negotiation Bullet Points for Future Agreement with CR&R Environmental Services Meeting Oct 13, 2022 - Board of Directors Study Session Access Public Type Discussion Goals 2.0 Solid Waste 10/10/22, 10:13 AM BoardDocs® Pro https://go.boarddocs.com/ca/cmsdca/Board.nsf/Private?open&login#7/16 Fleet Size - The fleet size will increase from 9 to 11 for implementing the 3-cart system. New vehicles will be phased-in, and there will be a minimum age requirement for the vehicles in service. The average age if the vehicle fleet shall not exceed seven years at any time during the term of the agreement. Cost - CR&R will not deviate from their proposed service hours for collecting a third cart (recycling) because additional trucks are required to provide the service. Contamination Fee and Notification Procedures – The notification procedure and fine will be consistent with administrative fines and protocols for storing trash carts in public view. The procedures will be as follows: Within a one-year period (12 months), residents will be notified about contamination in their carts. 1. 1 warning - a tag is placed on cart (CMSD recommend using a yellow-colored tag to catch residents’ attention). 2. 2 warning - a tag is placed on cart (CMSD recommends using a red-colored tag). 3. 3 warning – a letter is mailed to residents’ home. 4. If contamination is found in the cart after notifying residents’ three times within a 12-month period, a $25.00 fee will be issued to the resident. If three contamination fees are applied within one year then CMSD will resort to issuing administrative citations where the fine ranges from $75.00 to $300 for each offense. Contamination Fee Revenue - CMSD and CR&R agreed to share contamination fee revenues that’s consistent with the existing revenue sharing agreement for extra carts (80/20). CMSD receives 80% of the revenues while CR&R receives 20%. Rate Adjustments – CR&R can request rate adjustments annually. However, to avoid conducting Prop 218 hearings every year, CR&R will submit a five-year rate projection to be considered for Board approval where the COLA is based on Los Angeles-Long Beach-Anaheim CPI but capped at 5% per year. CR&R must provide documented justification for the rate adjustment and the rate adjustment cannot compensate losses from liquidated damages that were applied to CR&R if any. CR&R’s Performance Review – CMSD will not use the benchmarks earlier this year to approve or deny CR&R’s request for a rate adjustment. However, CMSD will have the right to deny a such request if CR&R receives “Unsatisfactory” in their annual performance evaluation and/or CMSD cannot afford a rate adjustment. Parameters for Replacing Carts – Residents can request replacing their carts by making such a request to CR&R. Proposed Contract – The contract will be an amendment to the existing 2018 contract. The Board will have the option to keep the existing term of the contract or they can consider a new term that will be the following: Ten-year agreement starting in 2023 with the option to solicit bids in 2033 or CMSD and CR&R mutually agree to extend the agreement for an additional five years Proposed Rate - The proposed monthly rate for implementing a 3-cart system is $24.16, but this rate is for 2023 when the 3-cart system was planned for roll out. The proposed rate will have to be adjusted with CPI when the 3-cart system is rolled out in January 2025. What the proposed rate will be in 2025 is yet to be determined. Legal Review Not applicable at this time; however, District Counsel will review, edit and approve the draft agreement before submitting it to the Board for approval consideration. ITEMS OF STUDY To: Board of Directors From: Scott Carroll, General Manager Date: October 13, 2022 Subject: Inspecting District Assets Using Drone Technology Summary Regular and routine inspection of assets is best practice to ensure assets are performing at their optimum levels during the full use of their life cycle. The District uses Closed Circuit Television (CCTV) technology to inspect sewer pipeline, but other assets such as sewer wet wells and pipeline located in confine spaces (e.g. Elden force main inside Mesa Drive SR 55 freeway overpass bridge) requires in- person inspection using confine space entry. Inspecting assets in-person is time consuming and confine space entry is dangerous for personnel, so staff researched alternative methods that are efficient and safer for staff. Staff discovered Flyability Elios 3 Drone technology that's designed and manufactured specifically for inspections. It's widely used for utility inspections including wastewater assets. A sales representative is located in Huntington Beach, so staff made contact with the vendor and requested a demonstration of the Elios 3 drone inside the Elden Lift Station wet well and the Mesa Drive SR 55 freeway overpass bridge. Recommendation That the Board of Directors receive and file this report. Analysis On July 7, 2022, staff received a demonstration of the Elios 3 at the Elden Lift Station wet well. Attached are pictures. The launch in the wet well was successful in which the drone was able to record the condition of the walls and the pipes inside the well. The Elios 3 is not waterproof, so the operator had to be careful the drone did not get wet from the water splashing inside the wet well. On August 29, 2022, staff received another demonstration of the Elios 3, but this time it was inside the Mesa Drive SR 55 freeway overpass bridge to inspect the Elden force main. Attached are pictures. A video of the inspection will be presented during the study session meeting. Unfortunately, the drone got snagged on a nail that required retrieval from staff after performing confine space entry. The operator agreed to return on September 26, 2022 to complete the inspection at no additional cost. While the technology is impressive, the cost to purchase one Elios 3 ranges from $51,600 to $74,500. Staff believes the cost is too expensive to purchase. Additional costs would apply such as training, maintenance, and supplies; however, the Elios 3 is available to rent at $3,000 a week or $7,500 a month. Staff believes renting the Elios 3 is a viable option for the District when inspecting confine space assets. A Federal Aviation Administration (FAA) license to fly the Elios 3 is not required because the drone is not flying in air space with other flying objects. Legal Review Not applicable. The following report provides details of the preparation leading up to and outcome of the event. Recommendation That the Board of Directors receive and file the report. Analysis The Costa Mesa Sanitary District has conducted a Citizens Environmental Protection Academy (CEPA) for the past several years which consisted of both in person educational workshops and tours of facilities such as OC Sanitation District, Orange County Water District, CR&R's Materials Recovery Facility, and Anaerobic Digestor Facility. The ability to conduct such tours during the pandemic has been paused for health and safety reasons. Staff revamped the CEPA structure and felt that participating in a Coastal Cleanup Event on Saturday, September 16 and creating an Eco Expo would be a great way to continue the District's outreach and education efforts, while keeping it interactive for all attendees. CMSD held its first Eco Expo on Wednesday, September 28 from 3pm - 7pm. The day and time of the event was set after soliciting the public via a Facebook poll as to what would day of the week and timeframe would attendees most likely be able to attend the event. Based on the number of school age attendees present, it seems that the 3pm - 7pm hours were ideal for parents who picked up their children from school and brought them straight to the Eco Expo. Staff received an RSVP count of 206, of which 130 attendees made the event. Along with all members of District staff, representatives from the Citizens Advisory Committee, the City of Costa Mesa, and CR&R were present to provide information about SB 1383 requirements and proper disposal of organics, wastewater do's and don'ts, how to join the CAC, and other district programs available to the public. The following budget summary covers all expenses entailed for the Eco Expo. Staff is pleased to report that the Eco Expo expenses were below budget and no additional funds were requested to cover the event.
