Minutes - Board - 2022-03-14COSTA MESA SANITARY DISTRICT MINUTES OF THE BOARD OF DIRECTORS SPECIAL MEETING MARCH 14, 2022 NOTE: THIS HYBRID IN -PERSON AND TELECONFERENCED MEETING WAS CONDUCTED UTILIZING ELECTRONIC MEANS CONSISTENT WITH STATE OF CALIFORNIA ASSEMBLY BILL 361(GOV. CODE 54953(B)(3)). Members present Arlene Schafer, Art Perry, Bob Ooten, Brett Eckles, Mike Scheafer Members absent None Staff present Scott Carroll (General Manager), Noelani Middenway (District Clerk & Public Information Officer), Alan Burns (District Counsel), Angela Colunga (Administrative Assistant I) Others present Deborah Diep, Center for Demographic Research at California State University, Fullerton Jim Mosher, District resident Meeting called to order at 4:30 P.M. A. OPENING ITEMS Procedural: 1. Roll Call - (If absences occur, consider whether to deem those absences excused based on facts presented for the absence - such determination shall be the permission required by law.) COSTA MESA SANITARY DISTRICT PAGE 2 MINUTES OF THE BOARD OF DIRECTORS SPECIAL MEETING HELD MARCH 14, 2022 District Clerk and Public Information Officer, Noelani Middenway, conducted roll call and noted that President Ooten, Vice President Scheafer, Secretary Schafer, Director Perry, and Director Eckles were present. B. PUBLIC COMMENTS Procedural: 1. Public Comments President Ooten opened public comments. Ms. Middenway stated that the Board received written public comments from District resident, Jim Mosher. She shared that District Counsel has responded to Mr. Mosher's comments. Hearing no additional comments, President Ooten closed public comments. C. PUBLIC HEARINGS Action: 1. Open Public Hearing - Consider Voting Division Adjustments After Decennial Census District Counsel, Alan Burns, provided an overview of the public hearing process. He stated that today's hearing is the second public hearing that the District is required to hold before adopting the revised map, which accounts for population variances in the District's voting divisions. He noted that, after the 2020 Decennial Census, a voting analysis was required to ensure that the voting divisions are within legally acceptable variations. He shared that the District's demographer, Deborah Diep, slightly adjusted the voting division boundaries to make them legally defensible. He stated that the District is recommending that the Board conducts the public hearing and adopts a resolution accepting the voting division adjustments. He announced that Ms. Diep is present to answer any questions. President Ooten opened the public hearing at 4:33 p.m. Action: 2. Secretary Schafer stated that her questions have been answered by Ms. Diep through email communication. President Ooten stated that Ms. Diep provided a presentation regarding the voting division adjustments at the previous public hearing. He asked if any Board members would like to receive the presentation again. Hearing no comments from the Board, he proceeded with public comments. Mr. Mosher commented that the District's Elections webpage currently has a map with detailed descriptions of the District boundaries. He stated that the current copy of the proposed resolution does not include a clear map. He noted that it includes a plan for a map that confusingly shows the existing District boundaries and blue shaded areas that depict the voting division adjustments between Districts 2 and 5. He suggested to adopt a new map with clear boundary lines rather than a plan for a map and to update the written descriptions of the map to reflect the adjustments. He inquired about providing the Census block listing on the District's website. Ms. Diep stated that she can remove the existing 2018 voting division boundaries so that the new map only depicts the proposed boundaries. She explained that both boundaries were included on the map to display the minor differences between the existing and proposed maps. She stated that the narrative descriptions are added after the plan is adopted. She noted that the Registrar of Voters requires a map or geographic information system (GIS) electronic files that show the adopted boundaries. She added that any additional information that is posted on a public agency's website is at the discretion of that public agency. She noted that the Registrar of Voters does not require the Census block listing. She expressed support for providing an updated narrative description of the proposed map. Vice President Scheafer asked if the map on the District's website with the blue shaded areas would be the same map that Ms. Diep is creating. COSTA MESA SANITARY DISTRICT PAGE 4 MINUTES OF THE BOARD OF DIRECTORS SPECIAL MEETING HELD MARCH 14, 2022 Ms. Diep stated that the new map would be similar to the 2018 map but include the updated voting boundaries. Vice President Scheafer asked if the Board is adopting the final version of the map at the March Board meeting. Mr. Burns stated that, if the map is not clear for adoption, then he would propose a brief recess to allow Ms. Diep to update the map. He noted that the Board does not have to adopt the final map today, but the public hearing was established to do so. Director Eckles reviewed the minor adjustments for the final map. Ms. Diep confirmed that the boundary adjustments will be reflected along Virginia Place between Districts 2 and 5. She noted that the new map is almost complete. Director Eckles recommended providing a written narrative for the new map on the District's website. The Board gave Ms. Diep a few minutes to readjust the final map. Ms. Diep displayed the newly created proposed map. She discussed the boundary changes of three street blocks from Division 2 to Division S. There were no additional comments. Action: 3. Close the Public Hearing President Ooten closed the public hearing at 4:48 p.m. Motion: To adopt Resolution No. 2022-956 revising the District's voting divisions after the 2020 decennial census. Motion by Art Perry, second by Arlene Schafer.
