A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA
SANITARY DISTRICT REVISING THE VOTING DIVISIONS OF THE DISTRICT
AFTER THE DECENNIAL CENSUS OF 2020
WHEREAS, the District previously had an "at -large" voting system; and
WHEREAS, the District was challenged in 2018 with a threatened lawsuit based
on the Federal Voting Rights Act and the California Voting Rights Act which alleged that
protected classes were caused "vote dilution" because those protected classes could not
elect candidates of their choice or otherwise influence elections; and
WHEREAS, in response, the Board of Directors determined to adopt a "by
division" voting system; and
WHEREAS, the Board caused a series of public hearings to be held before the
Citizens Advisory Committee and the Board itself, and employed a professional
demographer to prepare voting maps that established voting divisions that are roughly
equal in population, with no more than a 10% variation; and
WHEREAS those maps also considered permissible factors such as (1)
topography, (2) geography, (3) cohesiveness contiguity, integrity and compactness of
territory, and (4) communities of interest of the divisions; and
WHEREAS, after considering several maps, the Board adopted a resolution
which incorporated a map that took those factors into account: and
WHEREAS, any map adopted pursuant to the above authority must be revised
every ten years after the Federal Decennial Census is prepared; and
WHEREAS the Federal Census was delayed due to COVID-19 and the
California Legislature then provided that maps must be adopted by April 17, 2022; and
WHEREAS, the Board of Directors again retained the services of demographer
Deborah Diep through the Center for Demographic Research to analyze the census and
its effect on the existing map; and
WHEREAS, the demographer determined that two of the existing divisions might
no longer be roughly proportional; and
WHEREAS the demographer created a new map that made only slight
adjustments to two existing divisions; and
WHEREAS, the Board has now held two public hearings on the revised map and
has determined to adopt the map attached to this resolution.
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District
does hereby RESOLVE and DETERMINE as follows:
Section 1. That Pursuant to Elections Code Section 22000, the Board has adjusted the
voting divisions after the 2020 Federal Census in accordance with the criteria provided
therein, and does hereby adopt the voting divisions and map attached hereto as Exhibit
A.
Section 2. The application and terms of office shall be that members of the Board of
Directors of Divisions 2 and 4 were elected in 2020 and will be elected every four years
thereafter, while Directors in Divisions 1, 3, and 5 will be elected in 2022 and every four
years thereafter.
Section 3. Should any part, clause or section of this Resolution be declared by any Court
of competent jurisdiction to be invalid, the remaining provisions of this Resolution shall
nevertheless be and remain in full force and effect and the Board of Directors of the Costa
Mesa Sanitary District of Orange County, California, hereby declares that each and every
section, clause, provision or part of this Resolution would have been adopted and made
a part of this Resolution without the adoption of any portion thereof and that the invalidity
of any part or provision hereof shall not in any way affect the validity or enforcement of
the remaining provisions of this Resolution that may stand on their own.
Section 4. The District Clerk shall submit this resolution and map to the Orange County
Registrar of Voters for the 2022 election.
