Reso 1994-542RESOLUTION NO. 4- SwL A RESOLUTION OF THE BOARD OF DIRECTORS OF THE COSTA MESA SANI- TARY DISTRICT ADOPTING A LANG- STANDING POLICY OF ESTABLISHING PROCEDURES FOR DETERMINING SEWER ASSESSMENT RATES AND ESTAB- LISHING PROPERTY CATEGORIES FOR ASSESSMENTS AUTHORIZED, BY ORDINANCES 17 and 18 AND STATING REASONS THEREFOR. THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT DOES HEREBY RESOLVE AS FOLLOWS: THAT, WHEREAS, Ordinances 17 and 18 adopted May 12th and June 9th, 1983 created the District's sewer assessment district; and WHEREAS, a method must be established to calculate the rate necessary for the annual assessment and the procedure to be followed in obtaining Board approval of the rate to be subject to public hearing and adoption for the next fiscal year; and WHEREAS, due to different sewer disposal needs of different land uses, it is necessary to establish land use categories for application of assessment; NOW, THERFORE, BE IT RESOLVED: THAT sewer service assessment rates shall be established as follows: Utilizing the initial Manager /Engineer's Report, he and the Finance Director shall each year perform the following: a. Determine the funds to be collected for the maintenance and opera- tion of the District's existing sewer system. b. Using sewer flow curves, measured sewer flows, estimated sewer flows and the flow rates for each property category, establish the amount of funds to be collected from each property category. c. Submit by resolution for Board adoption the sewer assessment rate for each property category. d. Upon adoption of the rates by the Board, prepare or cause to be prepared the assessment role for submittal to the Orange County Assessor's office; and THAT all properties within the jurisdictional boundaries of the District will be assessed for sewer service. The property categories include, but are not limited to, single and multiple residential, mobile hone parks, commercial, indus- trial and institutional, "Institutional" includes, but is not limited to, hospi- tals, schools, colleges, governmental buildings, churches, fairgrounds, military installations and any other uses not herein described. Residential units shall be charged a flat rate, one rate for parcels zoned and developed as single - family detached residential and one rate for parcels zoned and developed as multiple - family residential. Commercial, industrial and institutional parcels shall be charged for 1,000 square feet of developed area (structures); and THAT when any exempt parcel or parcels which have had the floor area reduced or experienced a change in use, such as vacant to developed, redevelopment or increased use of floor area, or development requiring connection to District faci- lities, during any taxable year, the assessment provided for herein shall be due for the period of time in which sewer services were provided to the newly created uses during the time said parcels or floor area were not on the tax roll. -1- ATTEST: PASSED AND ADOPTED this N -a day of d4�,� _, 1994.
