COSTA MESA SANITARY DISTRICT, COSTA MESA, CALIFORNIA,
ORDERING THE VACATION OF THE DISTRICT'S INTEREST IN AN EASEMENT FOR
PUBLIC UTILITIES
WHEREAS, the relocation of a portion of the District's sewer system is necessary due to the
construction of a new building at 2051 Newport Blvd., Costa Mesa; and
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District has determined that the
hereinafter described public utility easement is unnecessary for sewer purposes due to relocation of a
portion of the sewer system and dedication of new sewer easements; and
WHEREAS, this resolution will not affect the location or use of the public utility easement by
owners of other public utilities;
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY
DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:
1. The District's interest in the easement for public utilities shall be vacated pursuant to the
provisions of Section 8333 et seq. of the Streets and Highways Code of the State of Califomia.
2. The description of the easement to be vacated is as follows:
As described in Exhibit `A' attached hereto and shown in Exhibit `B' attached hereto.
3. The easement to be vacated has been superseded by relocation and dedication of new easements
and there are no other public facilities located within the easement.
4. From the date this resolution is recorded the easement for public utilities no longer constitutes a
public service sewer easement.
5. The clerk shall cause a certified copy of this resolution to be recorded in the office of the Orange
County Recorder.

Thank you for your letter dated October 31, 2005 and supporting information
requesting the Costa Mcsa Sanitary District quitclaim its sewer casement that
traverses the Public Storage property at 2075 Newport Blvd. and the Daily Pilot
property at 330 W. Bay Street. The Sanitary District appreciates your work with
Public Storage to explain the sewer easement and the possibility of the District
quitclaiming its interest in the easement.
Because the Daily Pilot building has been demolished and because Public
Storage has submitted a letter dated October 5, 2005 requesting quitclaim of the
CMSD sewer easement, the District can quitclaim the sewer easement over both
the Daily Pilot property and the Public Storage properly subject to Public
Storage constructing a sewer cleanout on the sewer line on their property near
the property line of 330 W. Bay Street.
As discussed with you, your submittal is very thorough and in order, however,
the undersigned can only recommend to the Board of Directors of the District
that the quitclaim (technically termed a "vacation ") of the easement occur. The
Board is the voting body and no representation can be made of their action
before their official action occurs. Based on the information submitted, this
recommendation will be made.
The public agency vacation process has legal requirements that may cause it to -
occur over a few months, therefore, your request will be submittal to the CMSD
Board of Directors at the regular meeting on November 16, 2005 with a
. recommendation that the Board approve the request in concept subject to the
submittal of appropriate vacation documents and the construction of the
cleanout. There is probably no need for you to attend the meeting.

C. The Easement Deed was recorded in contemplation of the development
of the Property as commercial building sites, but the Property is now subject to a new
parcel map which provides for approximately 32 residential lots.
D. The rights reflected in the Easement Deed are no longer necessary or
desirable

Deed.
TERMS AND CONDITIONS
Quitclaim of Easement Rights. John A. Dick, Meridian, and Richard N. Dick,
as the owners of the Property, hereby release, remise, relinquish, extinguish, remove
and quitclaim to PUBLIC STORAGE, INC., all rights to use the Affected Portion of Lot
25 for the sewer and maintenance purposes which are reflected in the Easement Deed
and any and all other rights arising under the terms of the Easement Deed.

Dear Board of Directors:
Attached for Board consideration is acceptance of revised new sewer easements
along with a resolution to vacate the District's interest in a public utility easement
over the Self Storage property at 2051 Newport Blvd., Costa Mesa. The revisions to
the documents were made to accommodate the revised sewer alignment and the
previous documents were never recorded.
The new Self Storage building is causing the existing CMSD sewer line traversing
the property to be relocated. The relocation will be done at no cost to the District.
Staff recommends rescinding the previous approval of these easements and
resolution and acceptance of the new easements and adopting the resolution attached
hereto.

RESOLUTION NO. 2002 -663
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
COSTA MESA SANITARY DISTRICT, COSTA MESA, CALIFORNIA,
ORDERING THE VACATION OF THE DISTRICT'S INTEREST IN AN EASEMENT FOR
PUBLIC UTILITIES
WHEREAS, the relocation of a portion of the District's sewer system is necessary due to the
construction of a new building at 2051 Newport Blvd., Costa Mesa; and
WHEREAS, the Board of Directors of the Costa Mesa Sanitary District has determined that the
hereinafter described public utility easement is unnecessary for sewer purposes due to relocation of a
portion of the sewer system and dedication of new sewer easements; and
WHEREAS, this resolution will not affect the location or use of the public utility easement by
owners of other public utilities;
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY
DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:
1. The District's interest in the easement for public utilities shall be vacated pursuant to the
provisions of Section 8333 et seq. of the Streets and Highways Code of the State of California.
2. The description of the easement to be vacated is as follows:
As described in Exhibit `A' attached hereto and shown in Exhibit `B' attached hereto.
3. The easement to be vacated has been superseded by relocation and dedication of new easements
and there are no other public facilities located within the easement.
4. From the date this resolution is recorded the easement for public utilities no longer constitutes a
public service sewer easement.
5. The clerk shall cause a certified copy of this resolution to be recorded in the office of the Orange
County Recorder.

City of Costa Mesa, County of Orange, State of California, as per map recorded in Book
9, Page 9 of Miscellaneous Maps, in the office of the County Recorder of said County,
the centerline of which is described as follows:
Commencing at a point in the southeasterly line of the southeasterly 165.00 feet of said
Lot 25, said point being distant thereon North 39 °45'00" East, 44.02 feet from the
southwesterly line thereof;
Thence, North 50 °01'34" West a distance of 145.14 feet to a point in the southeasterly
line of the northwesterly one -half of said Lot 25, said point being the True Point of
Beginning;
Thence, North 50 °01'34" West a distance of 16.00.
The sidelines of said ten (10.00) foot wide strip shall terminate southeasterly in said
southeasterly line of the northwesterly one -half of said Lot 25, and northwesterly at right
angles to the centerline described herein.
