For valuable
consideration, receipt of which is hereby acknowledged, (V, We)
South Coast Plaza, a partnership
grant and convey to COSTA MESA SANITARY DISTRICT a perpetual easement and right of way for
Sewer purposes in, on and
over all that real property situated in the County of Orange, State of California, described as follows:
Those portions of Section 35, Township 5 South, Range 10 West in the land
allotted to James McFadden in Decree of Partition of the Rancho Santiago
de Santa Ana, recorded in Book "B" of Judgements of the 17th Judicial District
Court of Los Angeles County, situated in the City of Costa Mesa, County of
Orange, State of California included within those certain strips of land
10.00 feet wide hereinafter described in Parcels 1 and 2.
PARCEL 1: A strip of land 10.00 feet wide, the centerline of said strip being
described as follows: Beginning at the intersection of the centerline of
- Sunflower Avenue with the centerline of Bear Street as shown on the map of
Tract No. 7718, recorded in Book 303, pages 35 to 41, inclusive, of Miscella-
neous Maps in the office of the County Recorder of said Orange County;
thence along said centerline of Bear Street South 00° 48' 30" East, 1830.62
feet; thence East 62.96 feet to the Easterly line of Bear Street as described
in a deed to the City of Costa Mesa, recorded in Book 8864, page 963 of Official
Records, records of said Orange County; thence along the centerline of an
existing 8" V.C.P. sewer line the following courses; East 283.65 feet to a
manhole known as "M.H. #12" East 340.00 feet; North 63° 11' 21" East, 104.20
feet; North 440,.00 feet to a manhole known as "M.H. #16" and North 78° 10' 07"
East, 5.11 feet to a point in a line parallel with and distant easterly 5.00
feet, measured at right angles, from that certain course hereinbefore described
as having a bearing and length of "North 440.00 feet ", said point being the
True Point of Beginning; thence along the centerline of an existing 8" C.I.P.
sewer line North 78° 10',07" East, 29.37 feet to a manhole known as "M.H. #17 ";
thence along the centerline of an existing 4" C.I.P. force main North 89° 57'
49" East, 157.73; South 48° 56' 59" East, 31.82 feet; and South 25.60 feet
to an existing "Lift Station "; thence South 76° 00' 00" West, 5.78 feet to
the Easterly face of an existing parking structure. The side lines of said
strip of land are to be prolonged or shortened so as to terminate westerly
in said parallel line and southerly in the easterly face of said existing
parking structure.
PARCEL 2: A strip of land 10.00 feet wide, the centerline of said strip being
described as follows: Beginning at the southerly terminus of that certain
course hereinbefore described in Parcel 1 as having a bearing and length of
"South 25.60 feet "; thence along the centerline of an existing 8" V.C.P.

THIS AGREEMENT, made and entered into this 11 day of
January, 1974, by and between COSTA MESA SANITARY DISTRICT,
a district formed under the Act of 1923, hereinafter called "District"
and SOUTH COAST PLAZA, a partnership, hereinafter called
"Plaza".
WHEREAS, a pumping station has been constructed upon the
property of Plaza in accordance with the plans and specifications
heretofore approved by Plaza and District; and
WHEREAS, Plaza desires to dedicate the pump site and all
appurtenant improvements thereon to District in exchange for District's
agreement to operate and maintain said site; and
WHEREAS, the parties hereto now desire to set forth their
respective rights and liabilities relating to power for the operating of
said station;
NOW, THEREFORE, for and in consideration of the covenants
herein contained, performed and to be performed, the parties hereto
agree as follows:

As part consideration for the operation and maintenance by District
of the pump station upon Plaza property, Plaza agrees as follows:
II
Plaza agrees to provide the electrical energy service to the pump
site and to pay for electrical energy for the operation of said pumping
facility without cost to District.

III
District shall be responsible for the hook -up of electrical energy
from Plaza's terminal at the site to the pumping equipment electrical
motors and other electrical service requirements on the site.
IV
District agrees that the improvements are in accordance with the
mutually approved plans and specifications therefor, and hereby accepts
dedication of the pump site and appurtenant equipment, and District will
undertake the maintenance, care, upkeep and operation of said facility.
