over, all that real property situated in the County of Orange, State of California, described as follows:
All that certain land situated in County of Orange, State of
California. Beginning at the northeast corner of the land described
in deed to Guy L. Shiffer and wife, recorded February 19, 1952 in
Book 2289, page 517 of Official Records; thence northerly along the
northerly prolongation of the easterly line of said Shiffer land
1+39.95 feet to a point in the Northerly end of Olympic Avenue, as
said Avenue is shown on a map of Tract No. 3885, recorded in Book 144,
page l6, 47 of Miscellaneous Maps, records of Orange County,
California; thence Westerly parallel with the Northerly line of said
Sniffer land 10.00_ feet,- thence Southerly 439.95-feet-to a point in
said North line of said Shiffer land, said point being 10.00 feet
Westerly of Northeast corner of said Sniffer land; thence Easterly
10.00 feet to the point of beginning.
As shown on a map attached hereto and made a part of this description.
It is understood that the grantor grant. ..6_ only that portion of the above described land in which
he has an interest. Grantors, for themselves, their heirs, successors, and assigns, do hereby
release grantee, its officers, employees and agents, from any and all liability arising out of the use of said
land for the purposes stated or implied herein.

Subject: Acquisition of an easement for Sanitary
Lines - Bear Street School - To extend
to Olympic Avenue
Enclosures: Descriptions and Maps from Orange

Dear Mr. Southworth:
A necessary part of the acquisition will be an agreement
between the Sanitary District and the Costa Mesa Union School
District. Some of the points to be considered in effecting
the acquisition and payment are outlined below.
1. In order that the right of immediate entry can be
accomplished and the title of the easement vested in
the Sanitary District, the papers and acquisition in
eminent domain should be processed by the Sanitary
District.
2. The right of immediate entry must be exercised and the
School District allowed to proceed with the installation
of the required line.
3. Upon completion of taking of title, the School District
will at that time advance the purchase cost of the parcels
if they have not been dedicated free of charge.
4. The School District must be protected by reserving the
easement and line as a private easement - or as a pro-
tected easement - with a straight reimbursement agreement.
This is to be in effect for a minimum of 15 years --
possibly, more. The reimbursement agreement would return
to the School District the actual costs of the entire front-
age of each property owner who may wish to hook in, plus an

acreage prorated share of the cost of manholes connection
at Olympic, etc.
The costs of land and the cost of the line along each
frontage would be reimbursed to the School District. It
is possible that some negotiations or voluntary dedica-
tions with a contribution of line costs may be accom-
plished -- but, if they are, the parcel involved could be
dismissed at that time.
The School District Staff will be available to work on any
phase necessary in order to aid in the completion of this
project. The School District is ready to bid and start con-
struction on a school, and the work should not hold up the
school construction.
It is difficult to get a get a group of property owners to
agree in a short time on participating in a project of this
type. The information as to where sanitary facilities might
be in use was not exactly foreseeable at the time of the ac-
quisition of the school site due to the changing and growing
nature of the area. The large amount of fill and change of
street alignment, both north and south of the school site,
which is anticipated by the freeway division eliminates the
opportunity to plan sanitary lines along Bear Street -- or,
even, out to Paularino Street. The distance from the school
site to Olympic is shorter than any other possibility.
A previous letter was written to annex the school site into
the Costa Mesa Sanitary District. This should also apply to
the subject easements.
County Counsel has said that the papers for the acquisition
should be prepared by the Costa Mesa Sanitary District, not
the School District.
