RESOLUTION NO. 76 -295
A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE COSTA MESA SANITARY DISTRICT, ADOPTING
A CONFLICT OF INTEREST CODE APPLICABLE TO
THE MEMBERS OF THE BOARD OF DIRECTORS, PUR-
SUANT TO THE POLITICAL REFORM ACT OF 1974.
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY
DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:
THAT, WHEREAS, by initiative measure the Political
Reform Act of 1974 was duly adopted and is now codified under
Title 9, Chapters 1 through 11, 581000 through and including
§91000 California Government Code; and
WHEREAS, the Costa Mesa Sanitary District is an agency
as defined by §82003 Government Code and is governed by the
provisions of said Political Reform Act of 1974; and
WHEREAS, District is required, pursuant to §87300
Government Code to enact a Conflict of Interest Code; and
WHEREAS, the Board of Supervisors is, pursuant to
§82011 (b), the Code reviewing body; and
WHEREAS, said District has no employees and is operated
pursuant to contract with the City of Costa Mesa; and
WHEREAS, the Board of Directors of the Costa Mesa
Sanitary District in compliance with the aforesaid Government Code
sections adopts a Conflict of Interest Code and incoporates by
reference the Conflict of Interest Code of the City of Costa Mesa,
required pursuant to §87300 Government Code, insofar as the same
shall affect employees performing services under said contract
for the Costa Mesa Sanitary District;
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1: ADOPTION OF CONFLICT OF INTEREST CODE
In compliance with §87300 of the California
Government Code the Board of Directors of the Costa Mesa Sanitary
District hereby adopts this Conflict of Interest Code.

SECTION 2:
APPLICATION OF CODE
This Conflict of Interest Code shall be
applicable to members of the Board of Directors acting in their
governing capacity for the Costa Mesa Sanitary District, and
those members of the City staff of the City of Costa Mesa as shall
be required to report pursuant to the Conflict of Interest Code
required to be adopted by the City of Costa Mesa, pursuant to

§87300.
SECTION 3: DISCLOSURE
Members of the Board of Directors are re-
quired pursuant to Government Code §87300 to disclose investments,
interests in real property and income. No other or no additional
disclosure requirements are imposed by this Conflict of Interest
Code.
SECTION 4: CIRCUMSTANCES REQUIRING DISQUALIFICATION
Any member of the Board of Directors must
disqualify himself or herself from making or participating in
the making of any decision which will forseeably have a material
financial affect, distinquishable from its affect on the public
generally, on any economic interest as defined by Government Code
§87103. No member shall be prevented from making or participating
in the making of any decision to the extent his or her partici-
pation is legally required for the decision to be made.
SECTION 5:
District has no employees and is operated
by the City of Costa Mesa under the terms of an annual contract.
The City of Costa Mesa employees operating the District will be
governed by the Conflict of Interest Code adopted pursuant to
§87300 Government Code, and this Code is adopted herewith by
reference.

Except as otherwise indicated, the definition

the definitions contained in the Political Reform Act of 1974
(Government Code §81000 et seq.) and regulations adopted pursuant
thereto are incorporated into this Conflict of Interest Code.
SECTION 7:
The Clerk of the District is directed to forward
a certified copy of this Resolution to the Orange County Board
of Supervisors.
PASSED AND ADOPTED by the Board of Directors of the
Costa Mesa Sanitary District, at a regular meeting held on the
