Subject: Code Enforcement Officer Report – January 2016
This report summarizes major points for three ordinance enforcement topics covering
scavenging, graffiti, and trash container enforcement. For the month of January, the
CMSD Code Enforcement Officer focused his efforts on patrols in various parts of the
community. The goal is to identify and deter instances of scavenging and residential
trash carts left within the public view.
In the month of January, the District saw a number of complaints filed with CMSD
Code Enforcement staff regarding scavenging activity in the city. As with most
scavenging complaints, the alleged violations take place in the early morning hours. In
order to address resident concerns, the Code Enforcement Officer investigated all
complaints and adjusted his schedule to accommodate requests for early morning or
weekend enforcement. Included below are instances of scavenging that were detected
while the Officer was investigating specific complaints.
Proactive Scavenging Investigations: 08
1. 2045 Tustin Avenue- Officer Roberts observed a male subject pushing a
shopping cart containing what appeared to be recyclable material. As Officer
Roberts approached the location, he observed the subject rummage through
trash carts located in the 2000 block of Tustin Avenue. The individual was
contacted by Officer Roberts in front of 2045 Tustin Avenue and advised that
scavenging is a prohibited activity. The male subject cooperated with the
directive and returned all scavenged material to a nearby CMSD cart. The
subject then left the area without further incident.

2. 778 Shalimar Street – While patrolling the 700 block of Shalimar Street, Officer
Roberts observed a female subject walking along the sidewalk with trash bags
in her hands. As Officer Roberts drove closer to the female, he observed the
trash bags contained what appeared to be recyclable material. Officer Roberts
contacted the female in front of 778 Shalimar Street and asked her if she was
removing recyclable material from CMSD carts. The female subject was
cooperative and admitted to having removing recyclable items from CMSD
carts.
Officer Roberts advised the female regarding scavenging prohibition and told
her that if she is observed scavenging, she will be subject to immediate citation.
The female stated that she understood and left the scene without further
incident. All recyclable items that she had were left at the scene and deposited
them into a nearby CMSD cart.
3. 3078 Gibraltar Avenue- While patrolling the 3000 block of Gibraltar Avenue,
Officer Roberts’ attention was directed toward a male subject that had a trash
bag slung over his shoulder. As Officer Roberts drove closer, he observed the
male stop in front of 3078 Gibraltar Avenue and rummage through a CMSD
trash cart. Officer Roberts contacted the individual and asked about his
scavenging activity. The subject admitted that he routinely scavenges items
from CMSD carts. The subject was advised that scavenging is prohibited and
was instructed to return all recyclable material to a nearby trash cart. The
subject was sent on his way with a verbal admonishment.

4. 2904 Andros Street- Officer Roberts contacted a male subject at this location
for rummaging through a CMSD trash cart. The male subject stated that he was
from the neighboring City of Santa Ana and was unaware of scavenging
prohibitions. The subject was counseled and advised that scavenging is a
prohibited activity and sent on his way without further incident.
After the contact with the male subject, Officer Roberts was flagged down by an
area resident. The resident stated that he had observed the male scavenging in
the weeks prior and did not know who to contact. Officer Roberts provided the
resident with a CMSD business card and encouraged him to contact Code
Enforcement directly via mobile telephone should he have any further concerns.
The resident was advised and assisted and stated that he had no further
concerns.
5. 236 Amherst Avenue- In response to an electronic complaint (complaint #462)
filed by an area resident, Officer Roberts conducted directed patrols and
surveillance of the neighborhood. While patrolling the 200 block of Amherst
Avenue at approximately 0900 hours, Officer Roberts observed a female
subject rummaging through CMSD trash carts at that location. Officer Roberts
contacted the female and advised her that scavenging is a prohibited activity.
The female subject was identified by her presenting a California identification
card and later sent on her way. The female subject has not been observed
reoffending since this contact.

6. 286 W. Wilson Street – While patrolling the 200 block of W. Wilson Street,
Officer Roberts contacted a male subject at this location for rummaging through
a CMSD trash cart. The male subject was cooperative and advised that
scavenging is a prohibited activity. The male was sent on his way with a verbal
warning.
7. 2233 Republic Avenue- While patrolling the 2200 block of Republic Avenue,
Officer Roberts observed a male subject that was rummaging through a CMSD
trash cart in front of 2233 Republic Avenue. The male subject was advised that
scavenging is a prohibited activity and cooperative in his demeanor. The male
subject was sent on his way with a verbal warning.

8. 2086 Wallace Avenue – While patrolling the 2000 block of Wallace Avenue,
Officer Roberts contacted a male subject at this location for rummaging through
a CMSD trash cart. The male subject was cooperative and advised that
scavenging is a prohibited activity. The male was sent on his way with a verbal
warning.

Subject: 2015 Christmas Tree Recycling Program Update
Summary The Christmas Tree Recycling Program collects Christmas trees from residents and
recycles them into mulch. The mulch is then distributed locally throughout California
and used to enrich the nutrients in soil. When the anaerobic digestion facility becomes
operational (April 2016), Christmas trees will be deposited in the facility where the material will be converted into renewal natural gas and soil amendment. This program is made available to residents three weeks after Christmas. Staff is providing the
Board of Directors with a final report on the results of the program.
Staff Recommendation
Staff recommends the Board of Directors receive and file this report.
Analysis
In 2015, the Christmas Tree Recycling Program collected 4,719 trees from residents. In comparison to the previous year, which collected 6,132 trees, there has been a
7.7% decrease in the total amount of trees collected.
Despite the decrease in the amount of trees collected from residents, the findings
show a steady increase in the total tonnage of trees collected. In 2015, the total tonnage for Christmas trees collected was 82.48. In 2014, the total tonnage for trees
collected was 81.71, reflecting a 1% increase in the total tonnage collected.
The decrease in the overall amount of trees collected can be contributed to an
increase in purchasing artificial Christmas trees, while the increase in the overall tonnage can be contributed to purchasing authentic Christmas trees that weigh more.

District staff received a moderate amount of complaints regarding missed Christmas
tree pick-ups. CR&R indicated that the delay was caused by the storms (January 4 through January 8), which did not provide safe conditions for employees to pick-up
Christmas trees.

Summary
On Thursday, January 14, 2016 staff attended the OC Waste & Recycling
Coordinator’s meeting in Santa Ana. This report is a brief synopsis of the meeting.

Analysis
The meeting consisted of the following three (3) presentations:
• Mallory Burden from CalRecycle, provided information on AB 1826—
Mandatory Commercial Organics Recycling.
• Dr. Eric Handler from OC Environmental Health, presented on Waste
Not OC (WNOC).
• Scott Carroll from Costa Mesa Sanitary District and Mike Silva from CR&R, presented on the Organics Recycling Program.
1. Mallory Burden provided an update on AB 1826; information is available on the
CalRecycle website.
2. Dr. Eric Handler from OC Environmental Health, presented on Waste Not OC
(WNOC). WNOC is a public-private partnership formed with the goal of eliminating hunger and reducing food waste by facilitating the donation of
wholesome surplus food from food producing facilities to local pantries.
The overall vision of the coalition is to end hunger in Orange County using a

three pronged approach: educating the community about food donations,
identifying food scarce individuals, and connecting those individuals to sources of food.
3. Scott Carroll and Mike Silva presented on the District’s Organics Recycling
Program. The program uses Anaerobic Digestion technology to convert food
scraps and yard waste into renewable natural gas and fertilizer.

Units 1001 and 1014 (sewer combination trucks) are being maintained by the dealer.
Units 1007, 1008 and 1010 (bypass pumps) are being maintained by Charles King
Company, a vendor that specializes in wastewater bypass pumps. The remainder of
the fleet is maintained by the City of Costa Mesa. Staff believes there are three
options to consider.
1. Seek another public agency that is willing to maintain our fleet such as the City
of Newport Beach or Orange County Sanitation District.
2. Perform a hybrid approach where a qualified private vendor will maintain the
generators and a public agency will maintain Units 1004, 1006, 1009, 1012,
1013 and 1022. Typically, vendors will arrive at the Yard to perform
maintenance on the generators, which will allow staff to remain in the field
performing maintenance on the wastewater system instead of transporting
generators to the garage.
3. Do nothing and wait until the City of Costa Mesa is caught up maintaining their
fleet.

(CEQA) (Public Resources Code Section 21000 et. seq.) under Section 15301 as a

maintenance, permitting, leasing, licensing, or minor alteration of existing public
or private structures, facilities …”; pertaining to 15301(b) “Existing facilities of
both investor and publicly-owned utilities used to provide electric power, natural
gas, sewerage, or other public utility services”.

Financial Review
The City of Costa Mesa charges the District $97.60 an hour to perform maintenance
on our fleet. Parts are passed through to the District in which the District has an open
PO with the same parts vendor used by the City.

Subject: Inflow Reduction Program
Summary
Inflow is surface water entering wastewater systems. Excessive inflow in wastewater
systems can inundate treatment plants, which causes wastewater to flow backwards
uplifting manhole covers and causing sanitary sewer overflows (SSOs). The best way
to prevent wet weather SSOs is to reduce the amount of rain water from entering the
system. Staff believes the best method to reducing inflow is sealing and plugging
manhole covers.
Staff Recommendation
That the Board of Directors receive and file the report.
Analysis
The District has approximately 4,650 manholes within the system. The District’s Inflow
Reduction Program has been in place for several years by plugging and sealing 1,137
manholes. On October 8, 2015 staff had a meeting to discuss El Niño preparation in
which staff identified an additional 806 manhole covers to be plugged and sealed. The
locations staff focused on were city streets that historically flood (Attachment A are
maps showing the location of flooded streets. This information was provided by City
staff), as well as manholes located within 5’ to 10’ of curb and gutter, in alleyways and
near Mendoza and Irvine pump stations. Mendoza and Irvine pump stations have
historically received considerable amount of inflow in past storms.
The plugging and sealing of 806 manholes is complete. Nearly half of all manholes
within the system are now plugged and sealed, but it should be noted that not every
manhole has to be plugged and sealed to have a successful inflow reduction program.
Plugging every manhole will reduce the oxygen level circulating in the system causing
a buildup of hydrogen sulfide, which leads to more pronounced odors and corrosion in
the system.

In addition, the goal of the District’s inflow reduction program is to meet Orange County
Sanitation District’s (OCSD) standards by achieving rain ingress of less than or equal
to two percent.
In January 2016 there have been several El Niño type storms that occurred on January
4th through January 8th and another storm occurred on January 31st. Attachment B is
the daily precipitation report in Costa Mesa from the Orange County Public Works
Department. The report does not include the precipitation that occurred on Sunday,
January 31st, but according to the report in Attachment C Costa Mesa had 0.092
inches of precipitation, which makes the monthly total precipitation in January at 2.48
inches.
To determine the effectiveness of the District’s Inflow Reduction Program, a storm
event must produce more than an inch of rain within a 24 hour period. As you can see
in Attachment B, January 6th and 7th had more than one inch of rain. Attachment D is a
chart showing the rain ingress from the two storms, which is below two percent.
Strategic Plan Element & Goal
This item complies with Strategic Element No.1, Sewer Infrastructure and Strategic
Goal No. 1.2, Inflow Reduction Program.
Legal Review
Not applicable.
Environmental Review
Plugging and sealing sewer manholes is not a disturbance of the environment similar
to grading or construction and does not constitute a project under CEQA or the
District’s CEQA Guidelines.
Financial Review
The cost to plug and seal 806 manhole covers was $663.60 for materials only. The
materials used for plugging and sealing are corks and silicone sealant.
Public Notice Process
Copies of this report are on file and will be included with the complete agenda packet
for the February 9, 2016 Board of Directors study session meeting at District
Headquarters and posted on the District’s website.

Summary
At the January 28, 2016 Board of Directors meeting, Professional Pipe Services was
awarded a two contract to CCTV the District’s entire wastewater system for $625,553.28.
The budget for CCTV is $140,000 over the next two years, therefore an additional
appropriation of $486,000 is being requested from Retained Earnings.
Staff Recommendation

Analysis

Environmental Review
Subject activity is exempt from the requirements of the California Environmental Quality
Act (CEQA) (Public Resources Code Section 21000 et. seq.). Section 15300.4 of CEQA
allows an agency while establishing its own procedures “to list those specific activities
which fall within each of the exempt classes”, and the District has adopted “CEQA
Guidelines and Implementing Procedures” that state on page 6 “”Projects” does not
include …. C. Continuing administrative or maintenance activities.”
Financial Review
Sufficient funds are available in the Wastewater Retained Earnings account.
Public Notice Process
Copies of this report are on file and will be included with the entire agenda packet for the
February 9, 2016 Board of Directors study session meeting at District Headquarters and
on District website at www.cmsdca.gov.

Subject: Project No. 02-15 Closed Circuit Televising (CCTV) Services Award
Contract
Summary
Closed circuit television (CCTV) allows District staff to evaluate the condition of
wastewater pipes and can help determine when rehabilitation of said pipes are needed
before failure occurs. 2006 through 2009 was the last time the District CCTV the entire
wastewater system.
Staff Recommendation
That the Board of Directors award the contract to Professional Pipe Services, in the
amount of $625,553.28.
Analysis
The 2006-2009 CCTV allowed staff to identify 255 Grade 5 pipe sections, which
means imminent failure by the National Association of Sewer Service Companies
(NASSCO), an industry standard for assessing underground infrastructure. All 255
Grade 5 pipe sections have been successfully rehabilitated.
The 2006-2009 CCTV also identified 1,600 Grade 4 pipe sections, which means a
significant defect has been detected. It’s now time to CCTV the entire system again to
determine how many of the Grade 4 sections are now Grade 5 so staff can take
immediate action before pipe failure.
Staff prepared a request for proposal document to CCTV the District’s entire
wastewater system and requested qualified vendors to submit their proposal by
December 21, 2015. Staff requested proposals to CCTV the entire system in one, two
and three years.

Houston & Harris PCS miscalculated their proposal for years two and three and so
staff deemed the two cost proposals as non-responsive.
After evaluating all the proposals the preliminary “best value” proposal is from
Professional Pipe Services. On Wednesday, January 13th staff interviewed officials
from Professional Pipe Services to further evaluate their qualifications and experience.
After the interview staff is very satisfied with Professional Pipe Services experience,
equipment used, videos, and compatibility with GIS.
Professional Pipe Services has a fleet of 45 CCTV trucks in Southern California and
they are ready to begin work in February 2016. All of their technicians are certified
from NASSCO’s Pipeline Assessment & Certification Program (PACP) and they use
the latest pipeline inspection software (Wincan or Pipelogix) with PACP coding. They
are currently televising 500 miles of wastewater pipeline for the City of Los Angeles
and they recently completed CCTV inspection of 250 miles of wastewater lines for Los
Angeles County Sanitation District.
Strategic Plan Element & Goal
This item complies with Strategic Element No.1, Sewer Infrastructure and Strategic
Goal No. 1.5, Sewer Line Cleaning and CCTV Program.
Legal Review
District Counsel has reviewed and approved the attached contract.
Environmental Review
The proposed CCTV program is categorically exempt under the California
Environmental Quality Act (CEQA) (Public Resources Code Section 21000 et. seq.)
under Section 15309 Inspections as a “Class 9” activity described as: Class 9
consists of activities limited entirely to inspections, to check for performance of
an operation, or quality, health, or safety of a project, including related activities
such as inspection for possible mislabeling, misrepresentation, or adulteration
of products
Financial Review
Staff is recommending this program be completed in two years, which will cost the
District $312,776.64 annually. Currently, there is $70,000 budgeted for this program
in the FY 2015-16 and FY 2016-17 Budgets, so an additional $242,776.64 for each
fiscal year will have to be appropriated from the Facilities Revolving Fund which has
approximately $570,000.
