Subject: Code Enforcement Officer Report – June 2015
This report summarizes major points for three ordinance enforcement topics covering
scavenging, graffiti, and trash container enforcement. For the month of June, the
CMSD Code Enforcement Officer focused his efforts on patrols in various parts of the
community. The goal was identify and deter instances of scavenging and residential
trash carts left within the public view.
In the month of June we saw a reduced number of complaints filed with CMSD Code
Enforcement staff regarding scavenging activity in the city. As with most scavenging
complaints, the alleged violations take place in the early morning hours. In order to
address resident concerns, the Code Enforcement Officer investigated all complaints and adjusted his schedule to accommodate requests for early morning or weekend
enforcement. Included below are instances of scavenging that were detected while the
Officer was investigating specific complaints.
Proactive Scavenging Investigations:
1948 Anaheim Avenue- Officer Roberts observed a male subject that appeared to be
a transient, rummaging through trash carts along the 1900 block of Anaheim Avenue.
The individual was contacted by Officer Roberts in front of 1948 Anaheim Avenue and advised that scavenging is a prohibited activity. The male subject was cooperative,
returned all scavenged material obtained from CMSD carts and left the area without
further incident.

934 Cedar Place – While patrolling the 900 block of Cedar Place, Officer Roberts
observed a female subject walking with numerous trash bags in her hands. As Officer
Roberts drove closer to the female subject, he noted that the trash bags contained
what appeared to be recyclable material. Officer Roberts contacted the female in front of 934 Cedar Place and asked her if she was removing recyclable material from
CMSD carts. The female subject was cooperative and admitted to having removing
recyclable items from CMSD carts.
Officer Roberts advised the female that CMSD Code Enforcement conducts regular scavenging enforcement in the area and if she is observed scavenging, she will be
subject to immediate citation. The female stated that she understood and left the
scene without further incident. All recyclable items that she had with her were left at
the scene and Officer Roberts deposited them within a nearby CMSD cart.
785 Center Street- While patrolling the 700 block of Center Street, Officer Roberts’
attention was directed toward a male subject that was riding on a bicycle along the north curb line of Center Street. As Officer Roberts drove closer, he observed the male
stop his bicycle in front of 785 Center Street and rummage through a CMSD trash cart.
Officer Roberts contacted the individual and asked about his scavenging activity. The
subject admitted that he routinely scavenges items from CMSD carts in order to
support himself. The subject was advised that scavenging is a prohibited activity and was instructed to return all recyclable material to a nearby trash cart. The subject was
later sent on his way with a verbal admonishment.
492 Magnolia Street- Officer Roberts contacted a female subject at this location for
rummaging through a CMSD trash cart. The female subject was cooperative and
advised that scavenging is a prohibited activity. The female was sent on her way without further incident.
2160 Meyer Place- While patrolling the 2100 block of Meyer Place, Officer Roberts
observed a male subject rummaging through CMSD trash carts at that location. Officer
Roberts contacted the male and advised him that scavenging is a prohibited activity.
The male subject was argumentative, however after being advised that he was subject
to citation, stated that he understood and left the area without further incident. The male subject has not been observed reoffending since this contact.
2054 Monrovia Avenue – While patrolling the 2000 block of Monrovia Avenue, Officer
Roberts contacted a male subject at this location for rummaging through a CMSD
trash cart. The male subject was cooperative and advised that scavenging is a
prohibited activity. The male was sent on his way with a verbal warning.
591 Victoria Street- While patrolling the 500 block of Victoria Street, Officer Roberts
observed a male subject that was rummaging through a CMSD trash cart in front of 591 Victoria Street. The male subject was advised that scavenging is a prohibited
activity and cooperative in his demeanor. The male subject was sent on his way with a
verbal warning.

END OF SCAVENGING ENFORCEMENT REPORT
Trash Container Enforcement:
In the month of June, there were a few customer complaints reported to the District Headquarters regarding trash carts in public view. The following is a list of locations
where trash cart violations were found and addressed by the Courtesy Notice process.
Total Cases: 43

Subject: Board of Director’s Compensation via Direct Deposit Summary
The District’s Springbrook software upgrade has been completed and there are many
changes to current methods and processes as a result. One issue, is that the prior
version of Springbrook allow payroll to be printed on the same check stock as accounts payables which save money. However, payroll in the new software does not lineup correctly which would necessitate purchasing check stock for the Board’s payroll
or putting the Board on Direct Deposit. Staff would like to determine if the Board has
any interest in being paid via Direct Deposit.

That the Board of Directors provide staff with direction regarding paperless Direct
Deposit for the Director’s compensation.

Subject: Unfunded Retirement and Reserve Policy Review Summary
The Board of Directors has asked staff to review the District’s unfunded retirement
liability and reserves policies. To do this, staff is presenting the Board with a very high
level review of the next three years budgets, including several potential funding and reserve options.
Staff Recommendation
That the Board of Directors provide staff direction on the options to be brought back to
the July Board meeting.
Analysis
Attached are several schedules with projected revenues and expenses for the current
year through fiscal year 2017-18. For comparison purposes, each schedule includes a
summary of the actual revenue and expense activities for fiscal years 2011-12, 2012-13 and 2013-14, as well as the ending Retained Earnings. For the purposes of this
analysis, we assume Retained Earnings is equal to cash. Therefore, the ending
Retained Earnings balance in a given fiscal year becomes the beginning funds
available for the subsequent fiscal year’s spending. If the actual revenues exceed the
actual expenses, then Retained Earnings increases and there would be more funds available for future use. If the actual expenses exceed the actual revenues, then
Retained Earnings decreases, resulting in less funds available to meet future needs.
The next assumption made is that both the Solid and Wastewater Funds require at
least the equivalent of five months’ worth of operating expenses to meet the District’s cash flow needs. Cash flow is a very important part of the District’s reserve decisions

since there must be sufficient money available to pay expenses during the five months
when no assessments are received.
Solid Waste Attachment A1: This schedule shows that by the end of fiscal year 2017-18, the Solid
Waste Fund will not have enough cash flow using the “5 Months Cash Flow Needs”
methodology to cover expenses until the annual assessments start to come in from the
County. The Solid Waste Fund would have to temporarily borrow money from another
Fund, in order to meet its operating expenses. During the Budget cycle for the fiscal years 2017-18 and 2018-19, the Board will need to look at increasing the Trash
Assessments for fiscal year 2018-19.
The bottom of this schedule shows the Solid Waste’s portion of the estimated
Unfunded PERS and OPEB liabilities. Staff is recommending that the Board consider paying off the OPEB liability now and postpone any decision on the PERS Retirement
liability until the sewer hearing with the Regional Water Quality Control Board is
complete.
Attachment A2: This schedule reflects the same information as Attachment A1; however, it includes the District’s current Operating Reserve policy amount of 15% as
well as other possible reserve options. Staff is recommending that the Board increase
the Operating Reserve from 15% to 30%
Wastewater Fund Attachment B1: This schedule shows that by the end of fiscal year 2017-18, the
Wastewater Fund will have maintained its Retained Earnings balance by adopting a
balanced budget each year.
The bottom of this schedule shows the Wastewater Fund’s portion of the estimated Unfunded PERS and OPEB liabilities. Staff is recommending that the Board consider
paying off the OPEB liability now and postpone any decision on the PERS Retirement
liability until the sewer hearing with the Regional Water Quality Control Board is
complete.
Attachment B2: This schedule reflects the same information as Attachment B1;
however, it includes the District’s current Operating Reserve policy amount of 10% as
well as other possible reserve options. Staff is recommending that the Board increase
the Operating Reserve from 10% to 25%.
