A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
COSTA MESA SANITARY DISTRICT OF ORANGE COUNTY,
CALIFORNIA, OVERRULING PROTESTS. TO THE PROPOSED
USER FEE FOR LIQUID WASTE DISPOSAL AND ADOPTING
THE REPORT ON FILE WITH THE CLERK OF THE DISTRICT.
THE BOARD OF DIRECTORS OF THE COSTA MESA SANITARY DISTRICT,
ORANGE COUNTY, CALIFORNIA, HEREBY RESOLVE AS FOLLOWS:
WHEREAS, an ordinance providing for the collection of charges
of user fees for liquid waste disposal pursuant to Section 5473 of
the Health and Safety Code was passed and adopted on the 9th.day of
June, 1983, at .a regular meeting of said Board, in consolidation
with a public hearing conducted by Sanitation District No. 6; and
WHEREAS, thereafter a public hearing was set for the 10th
day of August, 1989, to be heard in the fifth floor conference room
of the Costa Mesa City Hall at 77 Fair Drive, Costa Mesa, California,
at the hour of 7:30 p.m.; and
WHEREAS, the District Clerk has heretofore caused notice of
said hearing to be published in,a newspaper of general circulation
within the DISTRICT, pursuant to Section 6066 of the Government
Code; and
WHEREAS, the Board has found and determined that assessor's
parcels are being considered in connection with this hearing; and
WHEREAS, the Board finds and declares that no written
objections, if any, filed prior to the time of the hearing and
oral objections, if any, expressed at the time of the hearing were
insufficient to constitute the owners of a majority of the separate
parcels of property described in the report as required by Section
5473.2, Health and Safety Code; and
WHEREAS, it is in order to overrule all protests, if any,
presented at the time and place of said hearing;
NOW, THEREFORE, BE IT RESOLVED that written protests, if
any, filed prior to the time and place for said public hearing
and any protests oral or written, if any, lodged at the time said
hearing be and are hereby overruled.
BE IT FURTHER RESOLVED that no modifications are necessary
in said report.
BE IT FURTHER RESOLVED that the computer roll presented as
the assessment roll is hereby adopted.
BE IT FINALLY RESOLVED that the District Clerk be instructed
to file a copy of the report and this Resolution with the County
Auditor prior to the 31st day of August, 1989.
