Subject: Amendment to the Waste Disposal Agreement with the County of Orange
Dear Mr. Carroll,
On behalf of the County of Orange, 1 would like to again thank you and the District for approving
the Amendment to the 2009 Waste Disposal Agreement (WDA). This Amendment would allow
the County to maintain stable waste disposal rates as well as a high level of service despite
significant declines in in-County waste in recent years. It would also benefit City WDA holders
through equitable sharing of significant out-of-County waste importation revenues over the term
of the agreement, including an initial payment of$79,976 to your city this coming fiscal year.
However, the Amendment is only effective with approval by all City WDA holders. To date, all
City WDA holders have approved the Amendment, except for the City of Irvine. If they do not
approve the Amendment, it will not become effective and its benefits will not be realized.
Additionally, due to the shortfall in tonnage delivered by the City WDA holders, the County may
be left with no alternative but to increase the WDA contract rate pursuant to Section 4.2(B).
Although the original Amendment approved by your District self-terminated on September 30,
2015, the Board of Supervisors has authorized an extension through December 31, 2015 to allow
additional time to address concerns or questions. Your District will also have to approve the
extension. We will be providing a copy of the revised amendment with supporting information to
assist in your preparation of an agenda item.
