AN ORDINANCE OF THE BOARD OF DIRECTORS OF
THE COSTA MESA SANITARY DISTRICT AMENDING
THE OPERATIONS CODE PERTAINING TO
CONFERENCES, TRAVEL AND EXPENSES
WHEREAS, the Board recognizes the benefit derived from Directors attending
educational seminars, conferences and political functions that occur outside of Orange
County; and
WHEREAS, current policy prohibits Directors from attending educational
seminars, conferences and government functions outside of Orange County without
prior Board approval; and
WHEREAS, many functions arise on short notice that may benefit the District if
the Board members attend, but current practice restricts the District's authority to
participate in those functions; and
WHEREAS, the Board does hereby desire to amend Operations Code Section
3.01.090 pertaining to conferences, travel and expenses to avail itself of in -state
opportunities without prior Board approval;
NOW, THEREFORE, the Board of Directors of the Costa Mesa Sanitary District
does hereby ORDAIN as follows:
Section 1. That Section 3.01.090 subsections (a) and (b) are hereby amended
to read:
"(a) The Board of Directors recognizes the benefit derived from Directors
attending educational seminars, conferences, programs, government hearings and
functions. No Board member shall incur such expense outside the state without prior
Board approval. This section constitutes the District's policy for expense
reimbursement, adopted in accordance with Government Code, § 53235.2.
(b) Board members are authorized to attend any educational seminar,
conference, program, political hearing and /or function within the State of California
without prior Board approval and to have such expenses reimbursed, subject to the
limitations provided for herein. Events must qualify as an eligible meeting pursuant to
District Operations Code, § 3.01.030.

Section 3. Should any part, clause or section of this Ordinance be declared by
any Court of competent jurisdiction to be invalid, the remaining provisions of this
Ordinance shall nevertheless be and remain in full force and effect and the Board of
Directors of the Costa Mesa Sanitary District of Orange County, California, hereby
declares that each and every section, clause, provision or part of this Ordinance would
have been adopted and made a part of this Ordinance without the adoption of any
portion thereof and that the invalidity of any part or provision hereof shall not in any way
affect the validity or enforcement of the remaining provisions of this Ordinance that may
stand on their own.
Section 4. Pursuant to Health and Safety Code Sections 6490 and 6491.3, the
Clerk shall cause this ordinance or a summary thereof to be published in a newspaper
of general circulation printed and published in the District according to law.
