Minutes of Adjourned Meeting from March 8th 1951, of
Board of Directors of Costa Mesa Sanitary District,
held at 2057 (Rear) Newport Avenue, Costa Mesa,
California, at 3 :00 0+clock P M, March 12th 1951.

Present: Directors Teti "tinkle, Nelson, Lord, Norman and Meyers.
Attorney Anderson, Secretary Owen.
Engineer Francis H Bulot.
Tabulation of the five lowest bidders was presented by Secretary,
reviewed by Engineer Bulot for information of the Board, and is
made a part of these minutes.
Mr Bulot stated that the "Cement mortar joint" bid determined the
low bid.
Secretary stated that he also had examined the several bids for
accuracy and found that of Michael Izzy to be accurately computed
and the lowest of all bids received.
The Board then conferred with Mr Michael Izzy, who had been invited
into the meeting, as to his ability in all respects to meet
specific requirements, considered conditions surrounding all bids
and authenticity of the five lower bids.
• Mr. Bulot Vemarked that Mr Izzy had examined specifications and
understands the plans, so that all matters of interpretation of--
same are understood, to which Mr Izzy agreed.
Tarr Izzy answered satisfactorily Director Nelson inquiry as to
type and extent of experience, availability of equipment and other
details, and offered references in all respects, ability to give
bond, membership in American General Contractors organization and
general capabilities to meet conditions of proposed contract.
In reply to President Tevlinkle's question as to relation of com-
pleted job of Sanitary District to contemplated facilities of Coun-
ty Sanitation Districts, Engineer Bulot stated that the last manhole
of the Sanitary District job'would correspond to the first manhole
of the Sanitation District facility - these have been established
so that they will connect - that the location of the County Sanita-
tion District trunk sewers are very definitely set so far as the
Sanitary District is concerned.
Mr Nelson inquired as to availability of bond proceeds for use in
work outside the present boundaries of the Sanitary District, in
view of apparent surplus of issue over now apparent cost of construc-
tion, and it was agreed that the bond issue was for a certain
purpose, viz., the work contemplated "Within the present Sanitary
District," or as existing.at time of bond proposal and election.
That bond funds may be used for additional work , such as sewer
lines in new developments, or newly created rights -of -way, serving
ptoperty within the District as then existing, providing therei.is
a sufficiency of funds to do so. Newly annexed territory to
District as it existed at time of Bond Proposal would have to be
independently financed by bond or improvement district process.

Mr Bulot: I did not recognize the fact that Mr Izz"° did not
sign the two specification bid forms at time of
filing bid.
Attorney Anderson: P,Zy interpretation is that he signed the bid
when he signed the contract. I think there is no
question as to the legality of the bid as presented.
Mr Bulot: Mr izzy has quoted '$400 00 for concrete manholes - if
we were to use concrete manholes we would have to
pay -00 00 each, under his bid. I think he should
make a statement as to how and why he reached that
figure.
m? Izz-;: I was of the impression that it was one deep manhole,
and I put the figure at X1400 00.
Wr Bulot: Some of the contractors thought it was a drop manhole.)
Mr Bulot:
We cannot ask Mr Izz. to change his bid, but we can
say to him, if he is given the job, what will his charge
be for concrete manholes? 1,;;400 00 would penalize the
Board. Don't think we will use this type of manhole,

but might want to use a few for the sake of local
industry.
Mr Izz,.,:
Concrete manholes should be about $195 00 or ;200 00
so long as not drop manholes.
Mr Bulot:
I am concerned. about the $l 00 per foot increase in
the coal tar joint bid, and wonder if I. r Izz` would
give the Board some information as to how this $3 63
or $1 00 increase over cement mortar bid throughout
was arrived at.
Mr Izz°%:
Explained as to extra labor requirements and various
conditions encountered in producing satisfactory "Hour
joints.
P =fir Norman:
You use these in water - you don't know whether you
will put any in or not?
Mr Bulot:
Don't think very many - have looked ground over and
don't think many trees or too much water.
TIr Izz:; :
Very little water.
Mr Bulot: As to performance and Labor and Material bonds. We
do not expect the Bonding Company to ever have to
come in here to do this job.
Mr Izz; I will guarantee,the job myself - I have all my own
equipment, and I will incorporate as to Equipment.

Mr Izz;, conft1d:
I am a member of the A G C.
Anything I can buy in Costa Mesa dollar for dollar,
I will buy in Costa Tfesa. I will hire all labor here
that I can - have to consider Union requirements.
Bonding Company. General Casualty.
At this point Mr Barnes of Concret Products Company, Costa Mesa,
was invited into meeting, and Mr Bulot stated, "We can say to
14r Barnes that this job was not set up to use concrete manholes,
except that the Engineer with the consent of the ~oard of Direc-
tors, might recorimiend the use of concrete .manholes, either
those produced by Mr Barnes or their equal. This is a deal
between the concrete material dealer andt'he contractor.
President TeWinkle: I feel sure if we use any concrete manholes
Tyr Izz,- will give consideration to Mr Barnes product..
Mr Izz and T,Ir Barnes had now retired from the meeting.
Tvir Bulot then reviewed his estimate of Mr Izz, -I s standing,
reputation, qualifications and general capacity to'. do the job
® The following Resolution was presented and upon motion by
Director Lord seconded by Director Meyers, same was adopted by
unanimous vote, all Directors being present and voting.

WI-EIREAS, .Examination of all bids for the construction of sewer
system within Costa Mesa Sanitary District, as received, opened
and read in meeting of the Board of Directors of said District,
held T:,Iarch 8th, 1951, disclosed that the bid of one Michael
Izzy-, was the lowest and best bid so received, opened and read,
and was in all respects regular and in conformity with bid
requirements as promulgated by this Board of Directors and
published according to law, now therefore,
BE IT RESOLVED, that contract for the
sewer system as provided in Plans and
said bid was made, be awarded to said

bonds be returned to unsuccessful bidders. Carried.
It was moved by Director Norman seconded byNels_on. that The Board
of Directors purchase $200 000 00 worth of District bonds in open
market and that Attorney Anderson and Secret Ohre be authori-
zed anJ empowered to negotiate such purchase. Tied.

Moved by Director Nelson, seconded by Director Meyers that
Michael Izz- be notified in writing of the acceptance of his bid
and award of contract, and that he be further notified in
writing to the effect that work under the said contract shall
begin on or before April lst 1951. Carried.
Meeting adjourned to roconvone at 11 o1clock A M March 13th,
for the purpose of receiving and acting upon Contractor's
Performance and Labor and Material bonds.

At the hour of 11 otclock A VI March 13th, there being present
Directors Ted "dinkle, Nelson and Lord, Contractor Izzy being
delayed and unable to appear at this hour, and it also being
., represented and understood that the form of bond was identical
with that embodied in Contract Documents and Specifications, it
was mutually agreed that the bonds would be in acceptable form
and substance and that same be accepted subject to approval of
Attorney Anderson and Secretary Owen. Such was the order.
Later P.r Izz putting in his appearance in company with Secretary
Owen visited Attorney Anderson at his office. T:rlr Anderson
examined the bonds and announced his opinion as to their validity
entire conformity, whereupon the Secretary received the originals
and included them in Office Official Copy of Contract Documents
and Specifications, and later received from ThIr Izz - the duplicate
copies and inserted them in Contractorts Official Copy of said
document.
