13 - Anaheim Avenue Sewer Re-Direction ProjectProtecting our community's health and the environment by providing solid waste and sewer collection services. www.cmsdca.gov Costa Mesa Sanitary District ….an Independent Special District Memorandum T o: Board of Directors Via: Scott Carroll, General Manager From: Rob Hamers, District Engineer Date: May 22 , 201 4 Subject: Anaheim Aven ue Sewer Re -Di rection Project Summary Under state law, if the City of Costa Mesa performs a street improvement projec t or installs a storm drain, all costs associated with adjusting manholes to grade or relocating sewers to avoid conflicts with the new storm drain shall be borne by the Costa Mesa Sanitary District (CMSD ). This applies to Mesa Water District and other utilities having lines in the City since the utilities are in the streets under franchise laws. In this case, the City is constructing a new storm drain in Anaheim Avenue that necessitates relocation of a CMSD sewer main, the cost of which is appro ximately $27,425 ($3,500 design and approximately $23,925 for construction.) The construction will occur in approximately two months. Staff Recom mendation That the Board of Directors approves appropriating $30,000 from the Asset Management Fund Retained Earnings to relocate the sewer mainline on Anaheim Avenue that will allow the City of Costa Mesa to complete their storm drain improvements. Anal ysis The cost of sewer work necessitated by city and county road and storm drain projects usually applies to adjusting sewer manholes to grade. However, over the years the District has relocated sewer mains when the agency owning the road completely reali gns the road. Examples are : ITEM NO. 13 Board of Directo rs May 22 , 201 4 Page 2 of 3 1. County of Orange realigning Irvine Av enue and Mesa Drive . 2. City of Costa Mesa realigning 17 th Street. 3. The City of Newport Beach re -aligning Superior Avenue (before this portion of the District was detached and then annexed by Newport Beach.) On the other hand, if the utility line pre -exists the road, relocation costs are borne by the road owner when the road is constructed. An example affecting the District is: 1. Caltrans constructing the 55 freeway at 21 st Street in 1990 causing the District to replace the gravity sewer with a pump station and force main located in a new utility bridge over the new freeway. Total Caltrans construction costs for removing the gravity sewer and constructing the pump station, force main, and utility bridge exceeded $1 million dollars. In the case of the Anaheim Sewer Re -Direction Project , the relocation costs are fortunately very small. This item was presented at the Board’s Study Session on May 13, 2014 in which the Board directed staff t o bring this item back to tonight’s meeting for approval consideration. Strategic Plan Element & Goal This item complies with Strategic Plan Element 1.0, Sewer Infrastructure and Goal No. 1.4 System Wide Sewer Replacement and Repair Program. The strateg y for this Strategic Element is ”We will do this by the careful management of the collection infrastructure using prudent planning and maintenance, with financial strategies to maintain sufficient capacity and respond to changing regulatory demands.” Leg al Review Who pays for the cost of utility line relocations is a complicated issue. Generally, first in time is first in right, but that rule is subject to the rule that if a street is involved, the entity that maintains the street has superior rights whe n improvements to the street are required. That rule only applies to improvements to the street and does not apply to relocation because a third -public entity, such as a flood control district, requires relocation. Since the “improvements” in this case a re storm water improvements that are owned by the city and involved in draining this street, they are probably correctly “street improvements,” and the District should pay the cost to relocate. Environmental Review The relocation of the sewer main under c onsideration involves construction of 18 linear feet of new 8” VCP sewer main and the construction of two sewer manholes, which is a very small amount of construction, and this level of construction is categorically exempt under the California Environmenta l Quality Act (CEQA) (Public Board of Directo rs May 22 , 201 4 Page 3 of 3 Resources Code Section 21000 et. seq.) under Section 15301 as a “Class 1” “minor alteration of existing public or private structures”, as further described in Section (b) as “Existing facilities of both investor and publicly -ow ned utilities used to provide …. sewerage …” Financial Review The total estimated cost of this project is $30,000 which will need to be appropriated from the Sewer Asset Management Fund Retained Earnings to account 20 -201305 -4300.
