Minutes of Board of Directors Regular Meeting held August 14, 1997
CALL TO ORDER The Board of Directors of the Costa Mesa Sanitary
District met in regular session on August 14, 1997,
at 6:00 p.m., conference room 1 -A of the Civic
Center, 77 Fair Drive, Costa Mesa.
Director Ferryman called the meeting to order at 6:00 p.m.
Director Perry led the Pledge of Allegiance.
Director Reade gave the invocation.

CONSENT CALENDAR

The Consent Calendar was amended to reflect two changes: a change in the
Investment Oversight Committee Meeting of July 10, 1997, to reflect a corrected
spelling of Director Schafer's name from "Arlene Schaefer' to "Arlene Schafer" and the
removal of item 10 under Treasurer's Reports, "Report of Monies on Deposit as of July
31, 1997." On motion by Director Perry, seconded by Director Reade, and carried 5 -0,
the Consent Calendar items, as amended, were approved as recommended.

PUBLIC HEARING - CONSIDERATION OF ANNUAL TRASH COLLECTION CHARGES TO BE
COLLECTED WITH THE GENERAL PROPERTY TAXES
PRESENTATION OF REPORT
Ms. Reba Coulter presented the report, dated July 28, 1997, reflecting a proposed
trash rate change as follows:
Ms. Coulter related the proposed decrease is due primarily to the decrease from $27 to
$22 per ton in the landfill fee, offset by the increase resulting from the lowered
occupancy count from 21,903 to 21,056. The trash charge is further reduced by the
refund of $11.30 overcharged from the previous year.
OPEN PUBLIC HEARING
President Ferryman opened the public hearing for consideration of the annual trash
collection charges to be collected with the general. property taxes. Ms. Madeline
Arakelian inquired whether the public hearing was advertised and whether the charges
would be collected with the general property taxes. President Ferryman responded the
hearing was correctly noticed to the public and that the trash collection charges would
be collected with the general property taxes.

President Ferryman closed the public hearing.

Mr. Hamers introduced an interoffice memorandum from Ms. Sandra M. Benson,
Senior Code Enforcement Office of the City of Costa Mesa, dated July 30, 1997.
Ms. Benson's memorandum advised one location was inspected for alleged
violations of CMMC 8 -81 (C), and a flyer left for educational purposes at the
location found to be in violation.

TELEPHONE DIRECTORY RECYCLING PROGRAM
Ms. Thompson reported the mini phone book recycling program has been
completed with a total of 11,700 directories, or 23.4 tons, being collected during
® the promotion. Ms. Thompson reported approximately 283 tons of phone books,
White and Yellow pages, are distributed in the City of Costa Mesa from Pac Bell
yearly.

Ms. Thompson further reported the District office received a request to add the
Davis School to the phone book program. President Ferryman advised there is
another new school opening, Rea, and requested Staff contact them regarding
participation in the next phone book recycling program.
LARGE ITEM COLLECTION PROGRAM
Ms. Thompson reported the Large Item Collection Program is currently in
progress and provided an update report for the Board. From the program's start
date of June 23, 1997, to August 1, 1997, a total of 256 tons of large items have
been collected and taken to the landfill at a total cost of $5,631.00. A credit in
the amount of $1,650.00 for recycled white goods was received. The program
will continue to August 29, 1997.
Ms. Thompson reported the District is still receiving reports that scavengers are
an issue where the white goods are concerned. The District has. provided the
volunteer unit of the Costa Mesa Police Department with a color -coded map
indicating the area of the City serviced each day in an effort to thwart
scavenging of these recyclable white goods.
• RECYCLING COMMITTEE
MEETING - AUGUST 13, 1997
Director Worthington reported the Recycling Committee met and discussed the
following two items:
MEDICAL WASTE RECYCLING PROGRAM
Director Worthington reported the Recycling Committee is in the process
of locating distribution points for a Home - Generated Sharps Disposal
Program. The Committee is seeking two locations, preferably retail drug
stores, to sponsor the purchase of containers for distribution, free of
charge to Costa Mesa residents, at an approximate cost of $3,250 per
year, per site. Ms. Thompson is drafting a sponsor proposal to present to
business owners describing the benefits to their firm for their participation
in the program.
Director Worthington further reported Ms. Thompson gave a presentation
to the County of Orange regarding the sharps disposal program. Director
Worthington advised the Board there may be money available to assist in
subsidizing the program through a state - funded grant program.
Ms. Thompson reported speaking with the Environmental Health Division
of Orange County and the Integrated Waste Management Board of

Orange County, and the County is interested in funding a regional
program. Ms. Thompson advised the Board the grant would fund the
purchase of the containers and the servicing of the containers monthly.
The grant would not provide funding for administrative support.
AD PLACEMENT, ORANGE COAST COLLEGE
Director Worthington advised the Board the Recycling Committee was
approached to place an advertisement in the Daily Pilot to commemorate
the 50th anniversary of Orange Coast College. Director Worthington
related the Committee determined an ad congratulating Orange Coast
College on their successful recycling program would be appropriate. The
cost for an ad would be $145.00.
Director Worthington further advised the Board the Committee was
approached to place an advertisement in the Daily Pilot's special three -
issue Costa Mesa Edition. The cost for an ad would be $250.00 for an ad
to run three days.
Director Schafer motioned the need to take action on the placement of an
ad in the Daily Pilot arose after the agenda was' posted and there was a
need to take action that could not await the next meeting. Director Reade
seconded. Motion carried unanimously.
Director Worthington motioned to approve the placement of the two ads
with the Daily Pilot, not to exceed $400.00 total. Director Perry seconded.
Motion carried 5 -0.
HIRING OF CONTRACT ENFORCEMENT OFFICER
Ms. Thompson advised the Board that Staff met with Sandy Benson, Senior
Code Enforcement Officer, regarding recruitment techniques to enable the
District to locate a part-time contract employee. Ms. Benson provided a list of all
of the Orange County code enforcement managers, suggesting an
announcement be mailed to them. Staff has also obtained a list of companies
providing contract code enforcement services. A letter has been sent to each of
these. companies requesting informational materials regarding the services each
of the companies provides.

OPPORTUNITIES IN FRANCHISING TRASH HAULING
REPORT ON ACTIVITIES
Mr. Hamers reported the City has not responded to the District's memorandum
suggesting three possible dates to continue discussions regarding opportunities
in franchising trash hauling.
President Ferryman suggested contacting the news media to discuss the issue.
Director Reade expressed his feelings that the District has spent enough effort
attempting to investigate the possible savings for the City and did not feel the
Board should expend any further efforts. Director Schafer echoed Director
Reade's comments.
Director Worthington stated that the District should continue its efforts to provide
the information obtained from the research to the City of Costa Mesa to provide
the best possible opportunity for the residents of Costa Mesa.
President Ferryman recommended educating the Chamber of Commerce on the
results of the survey and recommending they consider their options.
Mr. Burns. stated the District has not investigated its own authority to impose a
franchise system.
Director Reade motioned to table the issue of franchising trash hauling and stop
all further expenditures on the project. Director Schafer seconded. Motion
failed 2 -3 as follows:

Mr. Harriers determined projected attendance for the September 3, 1997 meeting
with the Chamber of Commerce and will notice the meeting as a special meeting.

Ms. Thompson provided a status report on the field study refund requests as
follows:

10, 1997, regarding the public vote to approve the lighting and landscape
assessment charge that was found to be in violation of Proposition 218. The
assessment charge was approved by a 4 -1 margin. The vote was conducted by
return mail ballot over a two -month period. In the article, Ms. Judy Vonada, City
Clerk, was quoted as saying "A substantial amount of the ballots were returned
to City Hall by the post office as undeliverable." Ms. Thompson contacted Ms.
Vonada and was told there were "many thousands" of undeliverable ballots. The
database source used for the mailing addresses was the Orange County Tax
Assessor records.
POLICY FOR UNDERCHARGES
Mr. Hamers introduced a refund request for Assessor's Parcel No. 139- 361 -35,
property located at 2699 Harbor Boulevard, Costa Mesa. Mr. Harriers explained
the property was incorrectly assessed as a single - family dwelling for both trash
disposal and sewer collection charges. The property is a commercial building
with a building area of 49,780 square feet. The trash charges of $472.98 were
assessed in error, but the sewer charges were undercharged by $1,930.59.
• Mr. Harriers explained undercharges are normally deducted from a refund due' to
the applicant. In this case, the undercharges, $1,930.59, exceeded the refund
due, $472.98. Mr. Harriers sought . direction from the Board regarding
undercharges that exceed a refund.

The Board determined the sewer bill shall be adjusted to reflect the correct
charges beginning fiscal year 1997 -98, and the Board will not require payment of
undercharges that exceed the amount of any refunds.
DISCUSSION OF PRINGLE BILL - AB556
Ms. Revak reported AB556 failed passage in the Senate Local Government
Committee on. July 16, 1997. Reconsideration was granted and on August 6,
1997, some technical amendments were made. The bill has been re- referred to
the Committee on Local Government.
DISCUSSION OF SENATE BILL 1179
Mr. Hamers presented a letter to President Ferryman from Ms. Marilyn Brewer,
Assemblywoman, 70th District, dated August 4, 1997. Ms. Brewer stated she
will give the Board's views serious consideration when the bill is presented to
her for a vote.
DISTRICT OFFICE COMMUNICATION IMPROVEMENTS
• Ms. Thompson reported the District office has improved the level of
communication in two areas. The District office is now online with access to the
Internet and e-mail. .Utilizing the e-mail address, Ms. Thompson has signed up
for a free subscription service with the California Senate. Updates to Assembly
and Senate bills are e- mailed automatically to the District as the bills move
through committees.
Ms. Thompson further reported the District has ordered a numeric pager from
PageNet. Ms. Thompson will wear the pager and be accessible to the Board
and Staff during times she is away from the office.
ENGINEER'S REPORTS
INDEPENDENT REVIEW OF 1997/98 CAPITAL IMPROVEMENT PROGRAM
Mr. Hamers presented the independent review of the 1997/98 Capital
Improvement Program from Boyle Engineering. Boyle Engineering reviewed the
District's Capital Improvement Program and determined the report to be concise,
well defined, and complete.
Director Perry motioned to approve the 1997 -98 Capital Improvement Program.

LICENSE AGREEMENT, 3150 BEAR STREET, COSTA MESA
Mr. Hamers reported Trinity Broadcasting Network inadvertently constructed two
new electrical vaults that encroach into the District's sewer easement that runs
along their east property line. Mr. Hamers has determined the vaults do not lie
over the sewer line and the installation did not impair the integrity of the sewer
line.
The cost to have the vaults relocated outside the easement would be
approximately $8,000. Mr. Hamers presented a license agreement proposed by
Staff to protect the District while allowing the vaults to remain in the easement.
The agreement reserves the District's right to have the property owner relocate
the vaults any time, as so directed by the District. Also, the property owner will
be responsible for all costs associated with, or caused by, the vaults.
President Ferryman suggested requiring Trinity Broadcasting Network to pay for
administrative time spent on this issue.
Director Schafer motioned to approve the license agreement with a condition
that $750 be paid to the District for reimbursement of Staff time expended.

TREASURER'S REPORTS
ORANGE COUNTY BANKRUPTCY
UPDATE
Ms. Coulter stated there was nothing to report to the Board.
Mr. Burns reported the lawsuit filed by Mr. Fine is moving forward. Mr. Fine's
lawsuit states the County's use of monies from areas such as transportation and
flood control to be used towards other areas is illegal.
AUDIT OF INVESTMENT POLICY
Ms. Coulter presented the report from the independent auditors, 'Conrad &
Associates, CPAs, LLP, concerning the District's investment portfolio as of
December 31, 1996. In summary, the report disclosed one recommendation:
that the District consider addressing the maximum maturity of investments in
money market mutual funds. The current Investment Policy has no maximum.
• This issue was discussed at the Investment Oversight Committee meeting of
July 10, 1997. It was the general consensus of the, Committee that no change
was needed to the existing Policy. This conclusion was reached based upon the

fact that the money market mutual funds in which the District can invest are
limited to a maximum maturity of 13 months by the funds themselves.

RESPONSE TO REQUESTS MADE AT INVESTMENT OVERSIGHT COMMITTEE MEETING
Ms. Coulter reported a request was made during the July 10, 1997, Investment
Oversight Committee meeting to present a bar chart of the Sanitary District's
monthly revenues. There was also a request for the fee charged by Conrad &
Associates for the audit and report on the agreed -upon procedures applied to
the investment portfolio. In response to the request, Ms. Coulter provided the
bar chart to the Board. The fee for the investment audit was $612.
ATTORNEY'S REPORTS
BRISTOL STREET WIDENING RIGHT -OF -WAY ACQUISITION - DISCLAIMER FILED
Mr. Burns determined the Bristol Street widening right -of -way acquisition would
not affect the District in any way. Mr. Burns advised a disclaimer was filed with
the court advising that the District is not seeking any compensation.

Ms. Revak know of their desire to attend.
Director Schafer informed the Board she filed the necessary papers to become
first vice president to ISDOC; but has not yet heard from Sterling Fox as to who
was appointed.
• LOCAL AGENCY FORMATION COMMITTEE ( LAFCO
Director Schafer reported the LAFCO meeting was lengthy and covered a great
deal of material. The major topic was Tri- Cities.
Mr. Harriers reported receipt of a letter from Jan Mittermeier, dated July 25,
1997, advising receipt of the Board's letter of endorsement of the Local Agency
Formation Commission's request for additional resources.
SPECIAL DISTRICT ADVISORY COMMITTEE
Director Schafer reported the Special District Advisory Committee did not hold a
meeting in August.

CITY OF COSTA MESA COUNCIL MEETING REPORT
JULY 21, 1997
Director Worthington attended the City of Costa Mesa Council meeting of
July 21, 1997. Director Worthington reported an item of significance to
the Board was an ordinance adopted making the dumping of pet waste
into storm drain systems illegal. Director Worthington reported the liquor
ordinance was discussed.

Director Perry attended the Council meeting of August 4, 1997, and
reported the main topic was the annexation of Bay Knolls into the City of
Newport Beach.

Ms. Ware didn't feel the telephone book recycling program was hands -on
recycling for the children.
Director Reade welcomed Ms. Revak back from her recent medical leave.
Director Reade inquired whether there was another toxic waste grant available.
Mr. Harriers reported there was nothing currently available. Ms. Thompson
stated she is monitoring the site on the Internet and will let the Board know if a
grant becomes available.
Ms. Schafer reported being invited to a reception featuring Bill Campbell on
September 17, 1997.
Ms. Reba updated the Board on Marilyn Rath's condition, stating she is feeling
better and is in good spirits.
President Ferryman directed Staff to send flowers to Ms. Rath on behalf of the
Board.
